土地承包经营权内在构造的深化改革

【摘要】:文章认为随着我国全面深化改革的不断推进,土地承包经营权制度在内在构造上面临着诸多挑战,需进一步予以完善:应修正以农地具有生存保障功能为内核、以农业户籍为标准而确立的土地承包资格,使二者之间实现脱钩。耕地"30年"承包期限的规定过于注重土地承包经营权用益物权属性的结果,土地承包制度的"长久不变"也不意味着土地承包经营权成为无期限物权,未来立法应设计土地承包经营权期限的弹性化制度。为进一步彰显土地承包经营权的私权属性,宜确立承包地动态调整制度,并就调整方式、调整时间等进行妥善安排。
[Abstract]:The paper holds that with the continuous progress of deepening the reform in an all-round way, the land contractual management right system is facing many challenges in its internal structure and needs to be further improved: the land contracting qualification established with the survival guarantee function of agricultural land as the core and the agricultural household registration as the standard should be revised so as to realize the decoupling between the two. The stipulation of "30 years" contract term of cultivated land pays too much attention to the result of the attribute of usufruct of land contractual management right, and the "long-term immutability" of land contract management system does not mean that the land contractual management right becomes indefinite real right. In the future legislation should design a flexible system of land contractual management right term. In order to further highlight the private attribute of land contractual management right, it is necessary to establish the dynamic adjustment system of contracted land, and make proper arrangements for the adjustment mode and time.
