互联网环境下中医药知识产权保护研究

【摘要】：文章针对一些国家、企业或个人对已过版权保护期限的古籍文献、早已记载于文献或公开的中医药配方抢先申请专利的行为,提出依据《生物多样性公约》中的国家主权、知情同意、惠益分享三原则和中医药特点,确立中医药作品、中医配方版权保护和中医药申报专利的新颖性、创造性判定标准,从而使中医药传统知识产权获得更好地保护。
[Abstract]:This article aims at some countries, the enterprise or the individual to have passed the copyright protection time limit ancient book document, has already recorded in the literature or the open Chinese medicine formula to apply for the patent behavior first. According to the three principles of national sovereignty, informed consent, benefit-sharing and the characteristics of Chinese medicine in the Convention on Biological Diversity, to establish the copyright protection of traditional Chinese medicine formulations and the novelty of Chinese medicine patent application. Creative judgment criteria, so that traditional Chinese medicine intellectual property rights to obtain better protection.
