保险产品的知识产权法律保护

【摘要】：我国的保险业正处于迅猛发展时期,市场竞争日趋激烈。对处于知识经济时代的保险业来说,研发先进的保险产品已成为市场竞争的有力武器,但作为颇有技术含量的保险创新产品并未受到知识产权法的应有保护,市场研发激励机制尚不够完善。文章以我国保险产品知识产权保护的现状为出发点,介绍和评价主要发达国家和地区保险产品知识产权保护的现状,特别是商业方法专利相关情况,阐述保险产品知识产权保护在知识产权保护体系中的应有地位,提出通过鼓励创新、行政手段保护以及构建商业方法专利等措施,加强我国保险产品知识产权保护。
[Abstract]:China's insurance industry is in a period of rapid development, and the market competition is becoming increasingly fierce. For the insurance industry in the era of knowledge economy, the development of advanced insurance products has become a powerful weapon in market competition. However, as an innovative insurance product with considerable technical content, it is not protected by intellectual property law, and the incentive mechanism of market research and development is not perfect. This paper takes the current situation of intellectual property protection of insurance products in China as the starting point. This paper introduces and evaluates the current situation of intellectual property protection of insurance products in major developed countries and regions, especially the situation related to the patent of business methods, and expounds the due status of intellectual property protection of insurance products in the intellectual property protection system. The measures of encouraging innovation, protecting administrative means and constructing patent of business methods are put forward to strengthen the protection of intellectual property rights of insurance products in China.
