【摘要】：在经济、文化一体化及现代生活方式的冲击下，传统文化的生存环境令人担忧。中国武术历史悠久，是中华民族宝贵的精神财富和文化遗产。作为我国民族传统体育的突出代表，武术也是我国非物质文化遗产保护的重要组成部分。目前，关于武术的开发利用日益普遍，给开发者和利用者带来了丰厚的收益。但武术权利主体的弱势地位及相关法律制度的缺失，很少分享到本属于自己的利益。由于年代久远，很多武术项目已经处于公开状态，在开发利用过程中忽视了其知识产权的保护，长此以往，势必会影响我国武术的传承与发展。正是在此背景下，本文查阅了大量的文献资料，对所搜集的资料筛选、分析、类比、归纳，从法律的角度，阐述了武术知识产权的相关概念及特征，分析了武术知识产权保护的正当性，探讨了武术知识产权的主、客体及权利内容，在武术知识产权法律保护现状的基础上指出了武术知识产权保护实践中存在的问题，最后提出了完善我国武术知识产权保护的相关建议，，以期有利于我国武术事业的发展。本文除了引言和结论外分为五个部分。第一部分，武术知识产权的相关理论研究。从知识产权的内涵入手，从内涵和外延两方面对武术知识产权的概念进行描述，并分析了武术的知识产权特征。第二部分，武术知识产权保护的正当性分析。对知识产权保护的目的、价值取向、内容等与武术的特点进行研究。并在此基础上分析了武术知识产权保护的必要性与可行性。第三部分，武术知识产权保护的主、客体及权利内容。在现行的知识产权法律体系特点的基础上，结合武术的实际情况分析了武术知识产权的权利主体、保护客体以及权利内容。第四部分，武术知识产权保护的现状及问题。首先对知识产权制度的演进与武术保护进行了分析；然后对武术的著作权保护、商标权保护、地理标志保护、专利及商业秘密保护分别进行分析；最后提出了武术知识产权保护实践中存在的一系列问题。第五部分，完善武术知识产权保护的建议。在前一部分研究的基础上提出了完善我国武术知识产权保护的相关建议。包括构建多方协作的立体保护体系；在充分利用现有法律保护的基础上积极借鉴国外特殊保护制度；建立武术知识数据库；建立武术知识产权公益诉讼制度；加强宣传教育，增强公众对武术知识产权保护意识。
[Abstract]:Under the impact of economic, cultural integration and modern way of life, the living environment of traditional culture is worrisome. Chinese Wushu has a long history. Wushu is the precious spiritual wealth and cultural heritage of the Chinese nation. As a prominent representative of Chinese traditional sports, Wushu is also an important part of the protection of the intangible cultural heritage of our country. At present, the development and utilization of Wushu are becoming more and more common. It has brought great benefits to developers and users. However, the weak position of the subject of Wushu rights and the lack of relevant legal system rarely share the benefits that belong to them. Because of their old age, many Wushu projects have been in an open state. In the process of development and utilization, the protection of intellectual property rights is ignored, and in the long run, it is bound to affect the inheritance and development of Chinese martial arts. From the angle of law, this paper expounds the relevant concepts and characteristics of Wushu intellectual property rights, analyzes the legitimacy of Wushu intellectual property rights protection, and probes into the subject, object and content of Wushu intellectual property rights. On the basis of the present situation of Wushu intellectual property protection, this paper points out the problems existing in the practice of Wushu intellectual property protection, and finally puts forward some suggestions on how to perfect the Wushu intellectual property protection in China. This article is divided into five parts besides introduction and conclusion. The first part, the related theoretical research of Wushu intellectual property, starts with the connotation of intellectual property, describes the concept of Wushu intellectual property from the aspects of connotation and extension, and analyzes the characteristics of Wushu's intellectual property. In the second part, the legitimacy of Wushu intellectual property protection is analyzed. The purpose, value orientation, content and characteristics of Wushu are studied, and the necessity and feasibility of Wushu IPR protection are analyzed. The third part, the subject, object and content of Wushu intellectual property right protection. On the basis of the characteristics of current intellectual property law system, this paper analyzes the subject of Wushu intellectual property right based on the actual situation of Wushu. Protect the object and the content of the right. Part 4th, the present situation and problems of Wushu intellectual property protection. Firstly, it analyzes the evolution of intellectual property system and Wushu protection, and then analyzes Wushu copyright protection, trademark right protection, geographical indication protection. Patent and trade secret protection are analyzed, and a series of problems in the practice of Wushu intellectual property protection are put forward. Part 5th, suggestions on how to improve the protection of Wushu intellectual property rights. Based on the previous part of the study, the author puts forward some suggestions on how to improve the protection of Wushu intellectual property rights in China, including the establishment of a three-dimensional protection system of multi-party cooperation. On the basis of making full use of the existing legal protection, we should actively draw lessons from foreign special protection system; establish Wushu knowledge database; establish Wushu intellectual property public interest litigation system; strengthen publicity and education, and enhance public awareness of Wushu intellectual property protection.
