企业PCT专利战略研究

【摘要】：经济全球化带来世界格局发生重大变化,企业的生存发展与专利布局联系日益紧密.在专利战面前,不仅需要策略的运用,更要注重对专利战略的整体把握。在知识经济时代，专利权不仅是一个法律手段，而且是一种市场策略。国外跨国公司通过制定PCT专利战略，将专利与企业经营管理融为一体实施专利战略，把自己的科技、品牌优势转变为市场竞争优势，利用专利权抢占他国市场制高点。近年来，我国企业逐渐认识到专利权对于自身发展的重要性，，并采取了一系列措施加强知识产权工作。但是站在国际视角来看，我国企业国际化经营的专利战略并不十分乐观。在我国企业国际化经营过程中，虽然有少数大规模集团公司将专利战略纳入企业生产经营战略，但绝大多数企业仍然缺乏专利战略思想，更未实施或计划实施知识产权战略。《专利合作条约》实施以来，我国多数企业并未充分利用该制度制定自己的海外发展战略，相反陷于外国企业通过PCT专利申请完成在华布局的专利网中。这其中既有国家立法层面上的缺失，也有企业知识产权意识不强的原因。本文通过DVD专利收费纠纷和深圳朗科诉PNY侵权案件分析我国企业面临的困境和可能的突围之路，对PCT申请进行了态势研究和深度分析，研究美日等国企业在华发展战略,同时对我国在PCT申请中存在的问题也进行了分析,提出应对方案建议。
[Abstract]:Economic globalization has brought great changes to the world pattern, and the survival and development of enterprises are increasingly closely related to the distribution of patents. In the face of the patent war, it is necessary not only to apply the strategy, but also to pay attention to the overall grasp of the patent strategy. In the era of knowledge economy, Patent right is not only a legal means, but also a market strategy. By making PCT patent strategy, foreign multinational corporations integrate patent and enterprise management to implement patent strategy and put their own science and technology into practice. In recent years, Chinese enterprises have gradually realized the importance of patent rights to their own development. And has taken a series of measures to strengthen the work of intellectual property. But from the international point of view, the patent strategy of international operation of Chinese enterprises is not very optimistic. Although a small number of large-scale group companies have incorporated patent strategy into their production and operation strategies, the vast majority of enterprises still lack the idea of patent strategy, let alone implement or plan to implement the intellectual property strategy. Since the implementation of the Patent Cooperation Treaty, Most Chinese enterprises do not make full use of the system to formulate their own overseas development strategy, on the contrary, they are trapped in the patent network where foreign enterprises complete their layout in China through PCT patent applications. There are also some reasons why the intellectual property awareness of enterprises is not strong. This paper analyzes the predicament and possible breakthrough road faced by Chinese enterprises through DVD patent fee dispute and Shenzhen Longke v. PNY infringement case, and makes a situation study and in-depth analysis on PCT application. This paper studies the development strategy of American and Japanese enterprises in China, analyzes the problems existing in China's application for PCT, and puts forward some countermeasures.
