论我国实用新型专利制度之完善

【摘要】：作为对发明专利的补充,实用新型专利因其成本小、价值大、易授权等优点而广受大众青睐,已然成为一项重要的知识产权。然而,由于我国市场经济体制的不成熟,过量申请实用新型专利极易造成创新力度不足、垃圾专利频现以及滥用权利救济等多种弊端,严重扰乱公平有序的竞争秩序。因此,须从专利契约论的视角对实用新型专利制度予以重新考量,进一步加强实用新型专利的审查及侵权惩处力度,并注重对公众利益的保护,从而重新激发实用新型专利推动科技进步和社会经济发展的积极效用。
[Abstract]:As a supplement to the invention patent, the utility model patent has become an important intellectual property because of its advantages of low cost, large value, easy to authorize and so on. However, because of the immature market economy system in our country, Excessive application for utility model patent can easily lead to insufficient innovation, frequent occurrence of garbage patents and remedy for abuse of rights, thus seriously disrupting the order of fair and orderly competition. It is necessary to reconsider the patent system of utility model from the perspective of patent contract theory, further strengthen the examination of utility model patent and the punishment of infringement, and pay attention to the protection of public interest. Thus, the utility model patent can promote the progress of science and technology and the positive effect of social and economic development.
