新疆知识产权保护地方立法问题研究

【摘要】：中国采取怎样的知识产权保护政策，已经成为其能否克服短期技术困境，促进经济长期增长的关键因素。虽然我国一直致力于知识产权法律体系的建构，并不断完善知识产权法律，但由于我国地域广阔，不同地区间都有自身特定的自然环境、历史文化环境和民族聚居问题。这些不同地区间政治、经济、文化的多样性、复杂性、不可复制性等因素，导致不同的地区在落实国家知识产权相关法律时产生的法律效果也不同，决定了新疆知识产权保护地方立法，，相对于国家知识产权立法具有不可忽视的地区优势和信息优势。毫无疑问，新疆知识产权保护地方立法与国家知识产权立法相比，前者更能为新疆提供充分、完善的法律保护。当今，新疆已经有很多关于知识产权保护的地方立法，但是这些知识产权保护的地方立法关注的内容大多集中在专利保护方面，忽视了保护新疆某些独有的知识产权资源。所以在新疆知识产权保护地方立法时，应结合新疆的实际情况，在开始进行知识产权保护地方立法时，首先应当对新疆的实际情况进行全面分析，结合新疆的实际情况区别立法的轻重缓急，慎重选择需要立法的项目，突出新疆知识产权保护地方立法的重点。为保障新疆知识产权保护地方立法的顺利实施，相应的还需增强新疆知识产权保护地方立法的可操作性，为其提供相应的资金保障和中介服务保障。建立新疆知识产权地方立法监督机制，推进新疆知识产权人才培养和文化建设，从而制定出符合新疆各民族需求的知识产权保护地方立法。
[Abstract]:What kind of IPR protection policy China adopts has become the key factor to overcome the short-term technical dilemma and promote the long-term economic growth.Although our country has been committed to the construction of intellectual property law system, and constantly improve the intellectual property law, but due to the vast area of our country, different regions have their own specific natural environment, historical and cultural environment and ethnic settlement problems.These factors, such as political, economic, cultural diversity, complexity and non-replicability among different regions, result in different regions having different legal effects when implementing laws related to national intellectual property rights.It is decided that the local legislation of intellectual property protection in Xinjiang has the regional advantage and the information advantage which can not be ignored compared with the national intellectual property legislation.There is no doubt that the local legislation on the protection of intellectual property rights in Xinjiang can provide adequate and perfect legal protection for Xinjiang compared with the national legislation on intellectual property rights.Nowadays, there are many local legislation on the protection of intellectual property rights in Xinjiang, but most of the local legislation on the protection of intellectual property rights focus on patent protection, ignoring the protection of some unique intellectual property resources in Xinjiang.Therefore, when making local legislation on intellectual property protection in Xinjiang, we should take into account the actual situation in Xinjiang. When we start to enact local legislation on intellectual property protection, we should first conduct a comprehensive analysis of the actual situation in Xinjiang.According to the actual situation of Xinjiang, this paper distinguishes the priority of legislation, selects carefully the items that need legislation, and highlights the focal points of local legislation on intellectual property protection in Xinjiang.In order to ensure the smooth implementation of the local legislation on intellectual property protection in Xinjiang, it is necessary to strengthen the operability of the local legislation on intellectual property protection in Xinjiang, and to provide the corresponding funds and intermediary services for the protection of intellectual property rights in Xinjiang.The local legislation supervision mechanism of intellectual property rights in Xinjiang should be established to promote the cultivation of intellectual property talents and cultural construction in Xinjiang so as to formulate the local legislation of intellectual property rights protection in line with the needs of all nationalities in Xinjiang.
