【摘要】：众所周知,当今世界知识产权已成为企业竞争力的核心要素之一,而企业是自主创新的主体,更是知识产权开发申请、综合运用和后续管理的主体,企业是否具有核心专利将是影响其生存的重要砝码。拥有知识产权可以将企业的技术优势转化为市场优势和竞争优势,在加强创造、运用和保护的同时,企业的知识产权管理尤为重要,提高企业的知识产权管理工作水平是增强自主创新能力的重要保证。对于企业而言,顺势且合度地管理知识产权,能够强化自身后续发展,有力抗衡竞争对手,以相对较小的投入得到较大的市场占有率;在技术研究开发方面,既可以使自身技术创新及时得到法律保护,也能实时掌握最新技术的发展方向,从中借鉴拓展适合自己当下的技术创新发展之路。本文选择一家具有示范效应的HS企业作为典型案例,进行实际应用案例分析。HS公司是一家专业生产冷藏、特种集装箱及活动房屋的中外合资企业,目前位居该行业的先进企业之一。HS公司生产的特种集装箱水平在国内排名第三、世界排名第五,其研发能力在行业中处于领先地位,具有较高的技术研发创新能力。随着企业经济效益大幅度提高,研发经费投入情况逐年递增,从而需要确保企业知识产权管理保持较高水平的快速发展。本文对HS企业知识产权管理情况的调查研究,借助专家评测AHP法等管理学工具,归纳了该企业知识产权开发申请、综合运用及后续运营的管理现状,同时结合HS企业实际发生的事例,分析HS企业知识产权管理中存在的问题及原因,最后根据专家评测及问题原因分析,相应提出针对HS企业的知识产权管理的改进建议,具体为配备经过专业培训的人才团队;委托代理机构;参与知识产权联盟;设立专项资金,有效实行激励制度;完善竞业限制协议等。通过实际应用结论,希望帮助HS企业员工提高知识产权管理意识,对知识产权更有效地进行管理,进一步增强企业核心竞争力,提升示范作用。
[Abstract]:As we all know, intellectual property has become one of the core elements of the competitiveness of enterprises in the world, and enterprises are the main body of independent innovation, and the main body of intellectual property development applications, comprehensive application and subsequent management.Whether the enterprise has the core patent will be the important weight that affects its survival.Owning intellectual property rights can transform the technological advantages of enterprises into market advantages and competitive advantages. While strengthening the creation, application and protection of intellectual property rights, the management of intellectual property rights of enterprises is particularly important.Improving the level of intellectual property management is an important guarantee to enhance the ability of independent innovation.For enterprises, managing intellectual property in a favorable and appropriate manner can strengthen their own follow-up development, be able to compete with competitors, and gain a larger market share with relatively small investment; in terms of technology research and development,It can not only protect its own technological innovation in time, but also grasp the development direction of the latest technology in real time.This paper chooses a HS enterprise with demonstration effect as a typical case to analyze its practical application. HS is a Sino-foreign joint venture specializing in the production of refrigerated, special containers and mobile houses.At present, the special container level produced by HS Company ranks third in China and fifth in the world. Its R & D capability is in the leading position in the industry and has higher technological R & D innovation ability.With the improvement of the economic benefits of enterprises, the investment of R & D funds is increasing year by year, so it is necessary to ensure the rapid development of intellectual property management of enterprises at a high level.Based on the investigation and study of the intellectual property management of HS enterprise, and with the help of management tools such as expert evaluation of AHP method, this paper sums up the management status of the enterprise's intellectual property development application, comprehensive application and subsequent operation.At the same time, combined with the actual cases of HS enterprises, the problems and reasons in the management of intellectual property rights in HS enterprises are analyzed. Finally, according to the evaluation of experts and the analysis of the causes of the problems, suggestions for improving the intellectual property management of HS enterprises are put forward accordingly.In particular, it is equipped with a team of trained professionals; entrusts agencies; participates in intellectual property alliance; sets up special funds to effectively implement incentive system; and consummates the agreement on the restriction of competition and so on.Through the practical application, the author hopes to help HS employees to raise the awareness of intellectual property management, to manage intellectual property more effectively, to further enhance the core competitiveness of enterprises, and to enhance the role of demonstration.
