产学研协同创新中的知识产权利益分配制度研究

【摘要】：产学研协同创新作为国家创新体系建设的重要一环,已经被提到了前所未有的高度,对产学研协同创新的相关问题的研究具有重大的现实意义。现代社会的竞争的关键是知识产权的竞争,知识产权对于协同创新主体自身的发展至关重要,是大学等学术研究机构和企业谋求控制的战略重点,科学、合理、有效的知识产权利益分配规则是产学研协同创新的重要一环。我国产学研协同创新的实践问题频发,现行的知识产权制度缺乏针对性、操作性和协调性,使得现行法律规范难以适应产学研协同创新实践的发展,有必要在利益平衡、动态变化和意思自治原则的指导下,从国家资金支持下的产学研协同创新整体与政府之间的知识产权利益分配、产学研协同创新成员之间的知识产权利益分配、产学研协同创新成员与其内部科技人员之间的知识产权利益分配三方面进一步完善知识产权利益分配制度。本文从以下几个部分对产学研协同创新中的知识产权利益分配制度的完善进行了探讨：第一部分,“产学研协同创新中的知识产权利益分配基本问题分析”。本部分重点分析了产学研协同创新中的知识产权利益构成,主要包括知识产权归属、无偿实施权、优先使用权、优先受让权、收益分配权、奖励请求权、报酬请求权、特殊情形下政府的介入权、二次创新及后续开发所形成的知识产权利益以及风险承担等内容;同时分析了不同的产学研协同创新模式及其效果；最后阐述了知识产权利益分配规则对产学研协同创新的重要性以及本论文研究的重要意义之所在。第二部分,“典型国家产学研协同创新模式及知识产权利益分配制度比较”。本部分从比较法的角度,探讨了美国、日本以及印度的相关做法。美国政府注重政策激励,同时强调法律法规的适时性；日本政府及时总结了产学研协同创新的失败经验,进行协调性的变革,在借鉴美国经验的基础上,探索适合自身具体情况的制度规范；印度的产学研协同创新的实践起步较晚,开始注重激励机制的构建。同时还分析了典型国家知识产权利益分配制度中的不足,引以为鉴。第三部分,“我国产学研协同创新中的知识产权利益分配制度现状及问题考察”。分别就我国产学研协同创新中的知识产权利益分配制度的实践探索和政策法律规定的现状进行分析,发现其中的问题。协同创新实践中的知识产权利益分配利益评估不协同、内容认定不全面、方式选择不科学、监督协调机制缺位；而理应发挥重要规范作用的法律、法规和政策也缺乏针对性、操作性和协调性。第四部分,“我国产学研协同创新中的知识产权利益分配制度的完善”。本部分重点分析了产学研协同创新知识产权利益分配机制的完善应该要以利益平衡、动态变化以及意思自治为原则,以最大程度的增进社会公益为目标,以法律法规以及相关机制的完善为主要方式,分情况,分阶段的建立完善的产学研协同创新知识产权利益分配制度。
[Abstract]:Collaborative innovation as the national innovation system construction is an important part, has been mentioned hitherto unknown height, is of great practical significance to study the related issues of collaborative innovation. The key competition in modern society is the competition of intellectual property rights, intellectual property rights is essential for the development of collaborative innovation main body, is the academic research institutions University and enterprise to seek strategic focus, control science, reasonable interest distribution rules of intellectual property rights is an important part of collaborative innovation.
Research and practice of collaborative innovation in the existing intellectual property system is lack of pertinence, operation and coordination, the existing legal norms is difficult to adapt to the development of innovative practice of cooperative research, it is necessary in the interests of balance, dynamic change and the principle of autonomy under the guidance of cooperative benefit allocation of intellectual property rights between the whole and the innovation the research from the state funds to support the cooperative benefit allocation of intellectual property rights between the members of the cooperative innovation, intellectual property interests between the members and their internal innovation of scientific and technological personnel distribution three aspects to further improve the distribution system of the interests of intellectual property.
From the following parts, this paper discusses the perfection of the system of distribution of intellectual property interests in the cooperative innovation of production, learning and research.
The first part is "analysis" of intellectual property interests distribution of basic problems in the innovation of collaborative research. This part focuses on the analysis of cooperative innovation in the form of intellectual property rights, including intellectual property rights, the implementation of free, priority, preemptive right, income distribution rights, the right to request the right to request compensation, reward, intervention the right of the government under special circumstances, the formation of the two innovation and the subsequent development of intellectual property rights and interests risk etc.; and analyzes different cooperative innovation mode and its effect; finally expounds the important significance of collaborative innovation and the importance of the research of intellectual property rights to the distribution rules of the research.
The second part, "the combination of typical national collaborative innovation mode and intellectual property interests distribution system". This part from the perspective of comparative law, discusses the related practices the United States, Japan and the India. The U.S. government pays attention to policy incentives, while emphasizing the laws and regulations timely; the Japanese government promptly summed up the cooperative innovation failure experience coordination of change, based on American experience, explore the rules for their own specific circumstances; India collaborative innovation research practice started late, began to focus on the incentive mechanism of construction. It also analyzes the lack of typical state intellectual property interests of the distribution system in it.
The third part, I research and collaborative innovation of intellectual property in the interest distribution system, the status quo and problems of investigation ". Respectively in China present situation research collaborative benefit distribution system of intellectual property in the innovation of the practice and the policy law to carry on the analysis, find out the problem. The distribution of interests the interests of intellectual property assessment collaborative innovation practice the content that is not comprehensive, coordinated, mode selection is not scientific, lack of supervision and coordination mechanism; and should play an important role in the legal norms, regulations and policies are lack of pertinence, operation and coordination.
The fourth part, I research and improvement of cooperative profit distribution system of intellectual property in the innovation. This part focuses on the analysis of the improvement of collaborative innovation of intellectual property interests distribution mechanism research should be the balance of interests, dynamic and autonomy principle, to the greatest degree of enhancing social welfare as the goal, to improve the law regulations and related mechanism as the main way of classification, stages of the establishment and perfection of the collaborative innovation of intellectual property interests distribution system.
