【摘要】：在知识经济时代，一个国家拥有的知识产权越多，就意味着在未来经济中拥有更多的控制权。其智力财富增长得越快，经济也就越发达。因此，最大限度的创造和利用知识产权成为各国积极探求经济发展的一个重要途径。我国在《担保法》和《物权法》中也肯定了知识产权质押的法律地位，但是实务中知识产权质押融资的发展却举步维艰。这主要是由于我国知识产权质押制度理论研究才刚刚起步，法律规范相对滞后，而现实需求强烈，尤其对于处在经济危机的科技型中小企业。因此，我国相关理论缺乏，难以为知识产权质押实践提供良策。鉴于此，文章对我国知识产权质押制度进行了阐述和分析，并在此基础上对国外的成功经验进行研究和借鉴，以期对我国知识产权质押制度理论研究有所裨益。首先，本文运用了逻辑分析法对知识产权质押的基本理论进行分析，，该理论部分包括知识产权质押的相关概念、知识产权质押的理论依据和法律依据、知识产权质押的构成要件以及客体范围；其次，运用文献分析和实证分析法对我国知识产权质押融资的现状进行多方面的分析，包括知识产权法律体系、知识产权质押客体、知识产权质押登记、知识产权质押保全以及知识产权质押评估等五个方面，并归纳总结出我国知识产权质押在上述几个方面中存在的问题；再次，运用比较分析法，通过对国外发达国家在知识产权质押的上述五个方面现状的比较研究，得出对我国知识产权质押制度的有益启示；最后，在对前文分析概况的基础上，提出在法律体系方面制定单行法、在质押客体方面扩大客体范围，并从我国现行知识产权质押评估、登记、保全等具体实践中，有针对性地提出在登记中统一登记规则，在保全中完善提存制度，在评估中明确评估人员的法律责任等具体建议。
[Abstract]:In the era of knowledge economy, the more intellectual property a country has, the more control it will have in the future economy. The faster its intellectual wealth grows, the more developed the economy will be. Therefore, creating and utilizing intellectual property to the maximum extent has become an important way for countries to actively explore economic development. Our country also affirmed the legal status of intellectual property pledge in the guarantee Law and Real right Law, but the development of intellectual property pledge financing is difficult in practice. This is mainly due to the fact that the theoretical study of intellectual property pledge system in China has just started, the legal norms are relatively lagging behind, and the actual demand is strong, especially for the small and medium-sized technological enterprises in economic crisis. Therefore, the lack of relevant theories in China makes it difficult to provide a good strategy for the practice of intellectual property pledge. In view of this, the article expounds and analyzes the intellectual property pledge system of our country, and on this basis studies and draws lessons from the successful experience of foreign countries, in order to be beneficial to the theoretical research of intellectual property pledge system in our country. First of all, this paper analyzes the basic theory of intellectual property pledge by logical analysis, which includes the related concepts of intellectual property pledge, the theoretical basis and legal basis of intellectual property pledge. Secondly, using literature analysis and empirical analysis to analyze the current situation of intellectual property pledge financing in China, including intellectual property legal system, intellectual property pledge object, The registration of intellectual property pledge, the preservation of intellectual property pledge and the evaluation of intellectual property pledge are summarized, and the problems of intellectual property pledge in the above mentioned aspects are summarized. Thirdly, the comparative analysis method is used. Through the comparative study on the five aspects of intellectual property pledge in foreign developed countries, the author draws some useful inspiration to our country's intellectual property pledge system. Finally, on the basis of analyzing the general situation of intellectual property pledge, In the aspect of legal system, the author puts forward a separate law, expands the scope of the object in the aspect of pledge object, and puts forward the unified registration rules in registration from the concrete practice of current intellectual property pledge evaluation, registration, preservation and so on in our country. To perfect the deposit system in the preservation, and to evaluate the legal responsibility of the personnel in the evaluation.
