【摘要】：商业方法专利是最近几年知识产权领域研究的焦点问题之一，商业方法最早在银行业萌芽，，可以说商业方法类专利在银行业申请最为活跃。本篇文章的主题便是从商业方法专利的产生和发展脉络出发，在商业创新和银行业商业方法及其专利保护的基本理论研究的起点上，分析我国银行业商业方法专利的现状和存在问题。本研究对我国银行业专利进行了细致的检索，并利用检索结果分析了我国银行业三类专利申请的现状和年度增长趋势，并多维度剖析了我国银行业商业方法专利的总体现状以及国内外银行业商业方法专利的发展差异。并在对检索结果分析的基础上，归纳了我国银行业商业方法专利发展的特点，其中主要包括我国银行的专利保护意识有了一定程度的提高，专利管理水平有所改进，但是专利结构不尽合理，只有量的优势而缺乏质的保证，核心的商业方法专利申请还有待进一步提高。相比之下，外资银行拥有更多的商业方法核心专利技术，并且美、英、日、韩等国的银行对我国银行的专利发展构成威胁。本研究从国家宏观政策、专利法律和行业意识以及经营环境等方面，对我国银行发展商业方法专利的环境进行了分析。还利用比较研究的方法，对美、日、欧的商业方法专利相关的专利法律及审查指南进行了研究。最后，结合实际情况，对我国银行发展商业方法专利对策进行了较为详尽的探讨。
[Abstract]:The business method patent is one of the focal issues in the field of intellectual property rights in recent years. The business method first sprout in the banking industry, so it can be said that the business method patent is the most active in the banking industry. The theme of this article is to start from the origin and development of business method patents, and the starting point of the basic theoretical research on commercial innovation and banking business methods and their patent protection. This paper analyzes the current situation and existing problems of commercial method patents in China's banking industry. This research has carried on the detailed retrieval to the banking patent of our country, and has analyzed the present situation and the annual growth trend of the three kinds of patent application of the banking industry of our country by using the retrieval result. It also analyzes the general situation of the banking business method patent and the development difference of the domestic and foreign banking business method patent. On the basis of the analysis of the retrieval results, this paper summarizes the characteristics of the development of commercial method patents in China's banking industry, which mainly includes the improvement of the awareness of patent protection of Chinese banks, the improvement of patent management, and the improvement of the level of patent management. But the patent structure is not reasonable, only the quantity advantage and the lack of the quality guarantee, the core business method patent application still needs to be further improved. In contrast, foreign banks have more core patent technologies for business methods, and banks in the United States, Britain, Japan, South Korea and other countries pose a threat to the patent development of Chinese banks. This study analyzes the environment of the development of business method patents in China's banks from the aspects of national macro policy, patent law, industry consciousness and business environment. The patent laws and review guidelines of business process patents in the United States, Japan and Europe are also studied by means of comparative research. Finally, combined with the actual situation, the author makes a detailed discussion on the development of commercial method patent countermeasures in Chinese banks.
