绿色贸易壁垒下中国农产品的地理标志权保护问题探析

【摘要】：绿色贸易壁垒作为一种新型的贸易保护手段,对我国的农产品出口贸易产生了一定的影响。伴随着科技的发展,农产品知识产权保护的内容也得到了不断的充实和完善,目前主要包括农产品专利权、植物新品种权、农业商标权、农产品地理标志权和农业科学成果及公共技术产权等方面。随着全球经济一体化的迅猛发展和科技竞争的不断加剧,农产品地理标志权保护不仅是各国强化科技竞争优势的具体体现,而且是谋求农产品贸易稳定、健康发展的重要手段。但是,当前我国的农产品地理标志权保护相对滞后,与农业贸易发展之间的矛盾日益突出,要应对农业领域日趋激烈的国际竞争环境,提高农产品的竞争力,我国必须尽快建立完善的农产品地理标志权保护体系以应对当前绿色贸易壁垒对我国农产品贸易的冲击。本文主要从农产品地理标志权保护的内容、农产品地理标志权保护在农产品贸易中的作用、我国农产品地理标志权保护的现状、应对绿色贸易壁垒的农产品地理标志权保护具体措施等几个方面来进行探讨。此文除引言和结语外,共分三章对此论题进行阐述。第一章对农产品地理标志权进行了概述。在此章首先明确了农产品地理标志权的概念,接着从生产者的权利、消费者的权利和环境权等三个方面来论述了农产品地理标志权的内容,最后讲述了农产品地理标志权保护在农产品贸易中的作用。第二章探讨了我国农产品地理标志权保护的现状。农产品地理标志权保护在我国还是一个较新的知识产权课题,我国法律也是近几年才有了对地理标志保护的专门规定。鉴于此,本章从当前我国农产品地理标志权的立法现状、实践现状和存在的问题三个方面进行了论述。第三章是应对绿色贸易壁垒的农产品地理标志权保护的具体措施。本文首先论述了农产品地理标志权保护与农产品贸易的关系,进而分析了当前我国地理标志权保护的现状及存在的问题,最后,毫无疑问要探讨应对绿色贸易壁垒的农产品地理标志权的具体保护措施。
[Abstract]:As a new means of trade protection, green trade barrier has a certain influence on the export trade of agricultural products in China. With the development of science and technology, the content of intellectual property protection of agricultural products has been continuously enriched and perfected. At present, it mainly includes agricultural product patent right, plant new product right, agricultural trademark right, agricultural product land. With the rapid development of global economic integration and the intensification of scientific and technological competition, the protection of the geographical indications of agricultural products is not only a concrete embodiment of the strengthening of the competitive advantage of science and technology, but also an important means for the stability of agricultural products and the healthy development of agricultural products. The protection of agricultural product geographical indication right in our country is relatively lagging behind, and the contradiction between the agricultural trade development is increasingly prominent. In order to cope with the increasingly fierce international competition environment in the agricultural field and improve the competitiveness of agricultural products, our country must establish a perfect protection system of agricultural products' geographical indications right as soon as possible in response to the current green trade barriers to our country The impact of agricultural product trade is mainly from the content of the protection of agricultural products' geographical indications rights, the role of the protection of agricultural products' geographical indications right in the trade of agricultural products, the present situation of the protection of the geographical indications of agricultural products in China, the measures of protecting the geographical indications of agricultural products with green trade barriers, and so on. The third chapter is the specific measures to protect the geographical indications of agricultural products with green trade barriers. This paper first discusses the relationship between the protection of agricultural product geographical indications and the trade of agricultural products, and then analyzes the current situation and existing problems of the protection of geographical indications in China.
