基于专利数据的“985工程”高校发明专利生存时间影响因素研究

【摘要】:自《专利法》实施以来,中国专利事业有了长足发展,每年专利中请与授权量不断增加,对经济发展、社会进步与国民生活水平的提高作出了巨大贡献。但专利申请数量的迅速增长并未有效提升中国创新能力,发明专利维持率低、生存期短,高校专利也存在重重问题。提升高校的发明专利产出质量和水平不仅关乎高校科技创新能力的建设,也直接关系国家自主知识产权战略的实施。面对这一问题,诸多学者展开了一系列的研究,但现有研究中针对高校这一主体的研究成果很少,而且由于数据可获得性方面的困难,中国也鲜有研究涉及专利引文数、非专利引文数与专利被引数对专利生存时间的影响作用。因此,为了明确"985工程"高校发明专利生存时间影响因素,为提高"985工程"高校发明专利质量提供参考,为探究专利引文数、非专利引文数与专利被引数在中国情境下的作用进行本次研究。本文首先对国内外相关领域研究进行梳理与分析,对其进行简要述评查找研究不足,为研究打下坚实的理论基础;随后之后基于成本收益理论,采用生存分析方法,构建"985工程"高校发明专利生存时间影响因素分析模型;然后通过包括国家知识产权局专利检索平台在内的专利数据库获取专利数据对"985工程"高校发明专利生存时间进行了实证研究;最后对研究进行分析和总结,对研究不足与未来研究方向进行说明。本文通过实证研究发现:(1)校企联合申请的发明专利生存状况远远优于其他类别专利权人的发明专利;(2)始终对"985工程"高校发明专利生存时间具有正向影响的因素包括:专利权人数、发明人数、说明书页、权利要求数。与国外诸多研究成果相似,专利被引数对发明专利维持或生存具有正向影响也得到验证。(3)审查时间始终对"985工程"高校发明专利生存时间存在不利影响;(4)专利.引文数与技术领域数对"985工程"高校发明专利生存时间影响具有不确定性,这或许与专利数据结构有关;(5)非专利引文数对"985工程"高校发明专利生存时间存在不利影响;(6)"985工程"高校发明专利生存时间影响因素在时间和空间上具有"动态性"。
[Abstract]:Since the implementation of the Patent Law, the patent industry in China has made great progress, and the number of patent requests and authorizations has been increasing every year, which has made great contributions to the economic development, social progress and the improvement of the people's living standards. However, the rapid growth of patent applications has not effectively promoted the innovation ability of China, the patent maintenance rate of invention is low, the survival period is short, and there are many problems in the patent of colleges and universities. Improving the quality and level of invention patent output is not only related to the construction of scientific and technological innovation ability, but also directly related to the implementation of national independent intellectual property strategy. In the face of this problem, many scholars have carried out a series of studies, but the existing research on the subject of colleges and universities is very few, and because of the difficulty of data availability, there are few studies on patent citations in China. The effect of non-patent citation and patent citation on patent lifetime. Therefore, in order to clarify the factors affecting the survival time of university invention patent in "Project 985", to provide a reference for improving the quality of invention patent in "Project 985" and to explore the number of patent citations, The role of non-patent citation and patent citation in Chinese context. This paper firstly combs and analyzes the related research at home and abroad, and makes a brief review and search for it, which lays a solid theoretical foundation for the research. Then, based on the cost-benefit theory, the survival analysis method is adopted. Constructing the "985 Project" university invention patent survival time factors analysis model; Then through the patent database including the patent retrieval platform of the State intellectual property Office to obtain patent data, the author makes an empirical study on the survival time of the "985 Project" university invention patent; finally, it analyzes and summarizes the research. The lack of research and the direction of future research are explained. Through empirical research, this paper finds that the survival condition of the invention patent filed jointly by school and enterprise is far better than that of other patentees.) it has always had a positive influence on the survival time of the invention patent of "Project 985" in colleges and universities. Similar to many foreign research results, patent citation has a positive effect on the maintenance or survival of invention patents and has been verified. The examination time has always had a negative effect on the survival time of university invention patents in "985 Project". The number of citations and the number of technical fields have uncertainty on the survival time of the "985 Project" university invention patent. This may be related to the structure of patent data. 5) the number of non-patent citations has a negative effect on the survival time of university invention patent in "985 project". 6) the factors affecting the survival time of university invention patent in "Project 985" have a "dynamic nature" in time and space.
