职务发明的权属制度的若干问题及其对策研究

【摘要】:职务发明制度是社会发展和科技进步的产物。职务发明的权利归属与利益分配,关系到发明人、发明人所在企业与整个社会等多方利益。合理的职务发明权属制度,有利于平衡各方面的利益,不仅影响着发明人及发明人所在企业从事发明创造的积极性,也影响着企业创新的持续发展与整个社会的科技进步和生产效率,对我国自主知识产权的形成和实施应用起到重要的积极作用。 本文以我国现行的职务发明权属制度为主要研究内容。全文除导言和结论外主要分为三个部分。文章第一章介绍了职务发明的权属制度现状,主要分为国内外研究综述、我国职务发明权属制度的规定和我国职务发明制度运行现状。文章第二章对我国职务发明权属制度存在的问题进行了分析探讨,包括职务发明的权利归属、职务发明的利益分配、企业对于发明人的奖励和报酬等激励措施、对职务发明相关制度的评估与考核、以及监管体系存在的漏洞等方面。文章第三章针对存在的问题对我国职务发明权属制度提出了相关建议,,希望能够更好地促进我国现行职务发明制度的建立和完善,更好地激发企业与发明人进行发明创造的热情,促进企业的技术创新,从而提升我国的科技水平。
[Abstract]:The system of job invention is the product of social development and scientific and technological progress. The ownership and benefit distribution of duty invention is related to the inventors, inventors' enterprises and the whole society. A reasonable system of ownership of job inventions is conducive to balancing the interests of all sides, and not only affects the initiative of inventors and inventors in their enterprises engaged in invention-creation, It also affects the sustainable development of enterprise innovation and the scientific and technological progress and production efficiency of the whole society, and plays an important and positive role in the formation and implementation of independent intellectual property rights in China. This article takes the present duty invention ownership system as the main research content. In addition to the introduction and conclusions, the full text is divided into three parts. The first chapter introduces the present situation of the tenure system of the job invention, which is mainly divided into the domestic and foreign research summary, the regulation of the tenure system of the duty invention in our country and the present situation of the operation of the duty invention system in our country. The second chapter analyzes and discusses the problems existing in the ownership system of job inventions in China, including the ownership of the right to the invention, the distribution of the benefits of the invention, the incentive measures of the enterprise to the inventor, and so on. The evaluation and assessment of the relevant system of job invention, as well as the loopholes existing in the regulatory system and so on. In the third chapter, the author puts forward some suggestions on the ownership system of job inventions in China, hoping to promote the establishment and improvement of the present system of job inventions in China. It can better stimulate the enthusiasm of enterprises and inventors to invent and create, promote the technological innovation of enterprises, and thus raise the level of science and technology in our country.
