网络版权保护中的法定许可与补偿金集成模式研究

【摘要】：随着互联网科技的深入发展，传统的网络数字版权制度正面临着严峻的挑战，尤其针对私人复制和传播侵权责任方面，现行的“权限加禁止权”模式已经无法担当起有效权衡各方利益和规范网络参与者行为的角色。作为弥补“权限加禁止权”模式缺陷的网络法定许可制度和补偿金制度，虽然都已在各自领域发挥着关键的作用，，并取得了相当好的效果，但同时也都具有其自身的局限性。如今急需一种全新的网络版权保护模式来填充上述两种制度的空白，而法定许可与补偿金集成模式（以下简称法定许可与补偿金模式）借助研究法定许可制度和补偿金制度的各自优势和劣势，充分并利用二者相互之间的补充性和共通性，将两种独立的制度有机结合起来，使这一组合模式在网络空间发挥更大作用，推动网络技术更好更快发展。法定许可与补偿金模式是指，版权人将自己所有的非营利性私人复制权和网络传播权通过授权形式指定特定的网络服务提供商代理行使，而被授权的网络服务提供商通过支付给版权人协议的法定许可费用与补偿金作为获得授权的对价，最后再由网络服务提供商通过普通网络用户基于网络服务的消费行为支付的费用，转移给版权人用以弥补其经济损失的一种全新的授权许可模式。除此之外，适应数字时代要求的数字权利管理系统和新型版权集体管理制度是这一模式的重要组成部分。通过本文论证：法定许可与补偿金模式正应了网络数字时代知识产权权利弱化的总体趋势，巧妙结合了法律稳定性与变化性的基本要求，符合知识产权法利益衡平的基本精神，并能够满足公共产品理论中的经济最大化要求，是解决网络版权保护危机的最切实有效的对策。不过，网络世界作品种类纷繁复杂且创作水平参差不齐，版权人和消费者也存在着不同的需求，法定许可与补偿金模式不可能成为网络版权包治百病的良方，因此其他种类的授权模式依然有其制度合理性，并在特定适用领域发挥其重要作用。事实上，从授权模式的宏观体系看，不同的授权形式体现着不同的作品保护力度层级和作品传播力的强弱，作为整个体系最重要一环的法定许可与补偿金模式只有与其他制度明确各自界限、相互衔接、相互配合才能实现版权制度的法律价值。因此，必须充分考虑到我国的立法现状和司法实践，并结合外国的先进经验，建立一套完善、高效的版权保护体系：（一）引入并完善补偿金制度及其运作模式，将补偿金制度用于解决P2P等网络传播软件的利益损害赔偿问题；（二）完善版权集体管理制度，建立延伸性、综合性且具有原告资格的集体管理组织；（三）根据法定许可与补偿金模式的需要，设计包括作品使用监督系统、作品检索系统、补偿金分配系统、作品补偿金支付系统等在内的数字版权权利管理系统；（四）重视协调完善其他网络版权保护制度形成多层次、综合化、公正、合理的网络版权新型保护体系。
[Abstract]:With the development of Internet technology, the traditional network digital copyright system is facing severe challenges. In particular, the current mode of "privilege plus prohibition" has been unable to play an effective role in balancing the interests of all parties and standardizing the behavior of network participants. The network statutory licensing and compensation system for the pattern of prohibition of rights, although they have played a key role in their respective fields and have achieved good results, have their own limitations at the same time. Now a new network copyright protection model is urgently needed to fill the blanks of the above two systems, and the legal license is permitted. With the compensation gold integration model (hereinafter referred to as the statutory license and compensation model), with the aid of the respective advantages and disadvantages of the legal licensing system and the compensation gold system, the combination of the two systems is fully combined to make the combination of the two independent systems to play a greater role in the network space. Promote network technology better and faster development.
The legal licensing and compensation mode means that the copyright owner designates a specific network service provider agent by authorizing all its private non profit and network communication rights and network communication rights in the form of authorization, while the authorized network service provider is authorized by the statutory license fee and compensation payment to the copyright owner agreement. In addition, the network service provider transfers the cost of the consumer behavior based on the network service by the network service provider and transfers it to the copyright owner to make up for its economic loss. In addition, the digital rights management system and the new copyright collective management system, which are adapted to the requirements of the digital age, are the same. An important part of the pattern.
It is proved by this article that the legal license and compensation gold pattern is the general trend of the weakening of intellectual property rights in the network digital age, ingeniously combining the basic requirements of the stability and variability of the law, conforming to the basic spirit of the equity balance of intellectual property law, and being able to meet the requirements of the economic maximization in the theory of public Communists and is the solution to the network. The copyright protection crisis is the most effective and effective countermeasures. However, the types of works in the network world are complicated and the level of creation is uneven. The copyright owners and the consumers also have different needs. The legal license and the compensation model can not be the good recipe for the network copyright treatment. So the other types of authorization mode still have its system. In fact, from the macro system of the authorization model, the different forms of authorization reflect the different levels of protection and the strength of the communication power of the works. The legal licensing and compensation mode, as the most important part of the whole system, is only defined by the boundaries of the other systems, In order to realize the legal value of the copyright system, it is necessary to take full account of the legislative and judicial practice of our country, and to establish a set of perfect and efficient copyright protection system based on the advanced experience of foreign countries: (1) introducing and perfecting the compensation system and its operating mode, and applying the compensation system to the solution of P2P Such as the compensation for damage of interests of network communication software; (two) improve the copyright collective management system, establish an extensible, comprehensive and qualified collective management organization with the plaintiff qualification; (three) design the use of supervision system, work retrieval system, compensation gold distribution system, compensation payment system, and work compensation in accordance with the needs of the statutory license and the compensation payment model. The digital copyright rights management system, such as gold payment system, and so on; (four) pay attention to the coordination and improvement of other network copyright protection systems to form a multi-level, comprehensive, fair and reasonable network copyright protection system.
