图形用户界面外观设计保护制度研究

【摘要】：随着科技的进步，特别是计算机技术的发展、成熟,图形用户界面在市场竞争中起着越来越重要的作用。我国政府及各大企业也越来越重视图形用户界面的法律保护。本文将对图形用户界面进行阐述，对比国外图形用户界面外观设计保护制度，就我国知识产权局新出台的《专利审查指南修改草案》，对我国建立图形用户界面外观设计保护制度进行研究，并就构建我国图形用户界面外观设计保护制度进行研究。本文将按以上思路分三个部分进行阐述。第一部分图形用户界面外观设计专利保护制度概述。图形用户界面是指供用户使用和操作电子产品的各种媒介，如电脑及手机上那些承载着某种功能的图标。而图形用户界面外观设计保护制度，起源于计算机技术发达的美国，欧盟、韩国、日本、台湾等国家和地区也先后建立了此项制度。第二部分我国建立图形用户界面外观设计保护制度的必要性。我国计算机技术起步相对较晚，图形用户界面外观设计保护制度对于我国来说有利有弊，但随着我国计算机技术的飞速发展及与国际的接轨。图形用户界面的外观设计保护制度已经成为一种必然趋势。第三部分构建我国图形用户界面外观设计保护制度。我国图形用户界面外观设计保护制度的建设才刚刚开始，，许多因素需要考虑。实务中对图形用户界面的保护需求也越来越迫切。因此构建图形用户界面外观设计保护制度是十分必要的。
[Abstract]:With the development of science and technology, especially the development of computer technology, graphical user interface (GUI) plays a more and more important role in market competition. Our government and major enterprises also pay more and more attention to the legal protection of graphical user interface. In this paper, the graphical user interface will be elaborated, compared with the protection system of foreign graphic user interface appearance design, Based on the revised draft of Patent examination Guide issued by China intellectual property Office, the establishment of graphical user interface design protection system in China is studied, and the construction of graphical user interface appearance design protection system in China is also studied. This article will be divided into three parts according to the above ideas. The first part of the graphical user interface design patent protection system overview. Graphical user interface (GUI) is a variety of media for users to use and operate electronic products, such as computer and mobile phone that carry some function of the icon. The graphical user interface design protection system originated in the United States, the European Union, South Korea, Japan, Taiwan and other countries and regions that have established this system. The second part is the necessity of establishing graphical user interface design protection system in China. The computer technology of our country starts relatively late, the protection system of graphic user interface appearance design has advantages and disadvantages for our country, but with the rapid development of computer technology in our country and with the international connection. The design protection system of graphical user interface has become an inevitable trend. The third part constructs our country graphical user interface appearance design protection system. The construction of graphic user interface design protection system in China is just beginning, many factors need to be considered. In practice, the protection of graphical user interface is more and more urgent. Therefore, it is very necessary to construct the graphical user interface design protection system.
