产学研协同创新知识产权冲突与协调机制研究

【摘要】:2010年4月,自胡锦涛在清华大学百年校庆讲话发表以来,产学研协同创新引起了社会的广泛关注,2012年12月党的十八大提出实施协同创新驱动战略,协同创新必将成为新的创新方式引领时代潮流。知识产权的应用和获得是产学研协同创新的本质,在协同创新的过程中知识产权冲突难以避免。知识产权冲突会阻碍产学研协同创新的顺利进行,给协同创新过程造成麻烦和损失,甚至可能导致产学研协同创新走向破裂。研究产学研协同创新知识产权冲突的机理,构建协调机制,减轻知识产权冲突程度,能够丰富产学研协同创新理论,为产学研协同创新联盟的持续健康发展提供强力支撑。根据阅读相关文献进行梳理总结,本文分析了产学研协同创新知识产权冲突形成机理,采用了模糊评价法度量产学研协同创新知识产权冲突的程度,构建了产学研协同创新知识产权冲突协调机制。首先,在对产学研协同创新、知识产权冲突相关文献进行梳理的基础上,加深了对产学研协同创新的理解,总结了产学研协同创新知识产权冲突的内涵,了解了产学研协同创新与知识产权之间的互动关系,归纳了知识产权冲突在各个阶段的具体表现。其次,在理解产学研协同创新知识产权冲突相关理论的基础上,从四个方面分析产学研协同创新知识产权冲突的形成机理,一是协同创新各主体之间的利益冲突,二是协同创新整体目标与各主体个体目标之间的冲突,三是相关政策不健全,四是第三方机构不完善。并且,运用演化博弈建立产学研协同创新知识产权冲突形成机理模型,深入细致地研究协同创新各主体之间的利益冲突,得到博弈系统的演化稳定策略,分析影响博弈系统向演化稳定策略演化的利益因素。再次,依据产学研协同创新接洽期、运行期、创新成果分配期的知识产权冲突的具体表现,确定度量产学研协同创新知识产权冲突程度的一级指标和二级指标,采用层次分析法计算各级指标权重,运用模糊综合评价法度量产学研协同创新知识产权冲突程度,并给出应用实例。最后,根据产学研协同创新知识产权冲突的形成机理,构建产学研协同创新知识产权冲突协调机制,包括利益协调机制、整体目标与个体目标协调机制、政策协调机制和第三方协调机制。创新之处主要表现在三个方面。一是运用演化博弈建立产学研协同创新知识产权冲突模型分析利益冲突机理。二是依据产学研协同创新接洽期、运行期、创新成果分配期的知识产权冲突的具体表现,确定度量产学研协同创新知识产权冲突程度的一级指标和二级指标,运用模糊评价法对产学研协同创新知识产权冲突程度进行度量。三是根据产学研协同创新知识产权冲突的形成机理,构建产学研协同创新知识产权冲突协调机制。
[Abstract]:In April 2010, since the publication of Hu Jintao's speech on the 100th anniversary of Tsinghua University, the cooperative innovation between industry, education and research has aroused widespread concern in the society. In December 2012, the 18th National Congress of the CPC put forward the strategy of driving collaborative innovation. Collaborative innovation is bound to become a new innovation to lead the trend of the times. The application and acquisition of intellectual property is the essence of collaborative innovation of industry, university and research, and it is difficult to avoid the conflict of intellectual property in the process of collaborative innovation. The conflict of intellectual property rights will hinder the smooth progress of collaborative innovation of industry, university and research, cause trouble and loss to the process of collaborative innovation, and may even lead to the breakup of collaborative innovation of industry, education and research. Studying the mechanism of IPR conflict, constructing coordination mechanism, reducing the degree of IPR conflict, can enrich the theory of IPR collaboration innovation, and provide strong support for the sustainable and healthy development of IPR collaborative innovation alliance. According to the relevant literature, this paper analyzes the formation mechanism of IPR conflict, and measures the degree of IPR conflict by fuzzy evaluation. The coordination mechanism of IPR conflict is constructed. First of all, on the basis of combing the literature related to industrial, academic and research collaborative innovation and intellectual property conflict, it deepens the understanding of industry-study-research collaborative innovation, and summarizes the connotation of IPR conflict of industry-study-research collaborative innovation. In this paper, we understand the interactive relationship between innovation and intellectual property rights, and summarize the concrete manifestation of intellectual property rights conflict in each stage. Secondly, on the basis of understanding the relevant theories of IPR conflict, this paper analyzes the formation mechanism of IPR conflict from four aspects. The second is the conflict between the overall goal of collaborative innovation and the individual goal of each subject, the third is the imperfect related policies, and the fourth is the imperfection of the third party organization. Furthermore, by using evolutionary game to establish the mechanism model of IPR conflict, and to study the conflict of interest among the subjects of cooperative innovation, the evolutionary and stable strategy of the game system is obtained. The benefit factors influencing the evolution of game system to evolutionary stabilization strategy are analyzed. Thirdly, according to the specific manifestation of IPR conflict in the contact period, operation period, and distribution period of innovation results, we determine the primary and secondary indicators to measure the degree of IPR conflict. The index weight of all levels is calculated by analytic hierarchy process (AHP) and fuzzy comprehensive evaluation method is used to measure the conflict degree of intellectual property rights (IPRs) in collaborative innovation between industry, university and research, and an application example is given. Finally, according to the formation mechanism of IPR conflict, this paper constructs the coordination mechanism of IPR conflict, including interest coordination mechanism, overall goal and individual goal coordination mechanism. Policy coordination mechanism and third party coordination mechanism. Innovation is mainly reflected in three aspects. The first is to analyze the mechanism of conflict of interest by using evolutionary game to establish the model of the conflict of intellectual property rights. Second, according to the specific manifestation of intellectual property conflict in the contact period, operation period, and distribution period of innovation achievement, the first and second level indexes to measure the degree of the conflict between industry, university and research cooperative innovation intellectual property rights are determined. Fuzzy evaluation method is used to measure the conflict degree of IPR. Thirdly, according to the formation mechanism of IPR conflict, we should construct the coordination mechanism of IPR conflict.
