重庆市专利产业化现状问题与对策研究

【摘要】：作为促进科技进步和创新的重要法律制度，专利对经济贸易活动的影响显著增强，已经成为衡量国家和地区综合实力的重要指标，专利日益受到我国政府、企业等主体的高度重视。专利是地区科学技术发展的重要表现形式，代表着自主创新的成效，专利技术向现实生产力的转化不仅可以提高生产效率，还将拉动经济发展。重庆市是我国西部唯一的直辖市，引领西部地区的发展，对西部的经济发展发挥着举足轻重的作用。经过多年的发展，重庆市的专利申请量和授权量已有较大幅度提升，但从专利质量来看重庆市创新能力及动力不足，，专利产业化发展存在较多问题，专利产业化仍刚刚起步，困难重重。因此，如何加快推进重庆市专利产业化发展，通过专利拉动发展，形成规模经济，是重庆市当前必须解决的重要难题，是发展知识产权强市的必经之路。首先，本文从理论上探讨专利产业化相关专业词汇的内涵与实质，指出专利产业化是指对专利技术进行再开发，通过实验、组合、生产、应用、推广等诸多环节，形成工艺、材料、产品，进而通过产品化、商品化的形式创造价值，直至发展成新产业的过程。与专利实施、专利转移、专利转化、专利商业化存在本质区别。其次，从重庆市专利研发情况、专利发展情况、产业化情况以及中介服务体系建设情况等剖析重庆市专利产业化发展现状，并从中分析重庆市专利产业化堪忧的主要原因包括研发投入不足、企业尚未成为专利产业化主体、高校专利技术成果与市场脱节等。最后，依据协同创新理论，从协同动因、协同影响因素、协同框架三个方面探讨了构建专利产业化协同机制的必要性，指出专利产业化协同机制的构建将涉及专利产业化的各个主体有机结合起来，激发主体间的协同动力，以促进专利产业化的推进。并为重庆市专利产业化协同机制运行提出针对性的对策建议。
[Abstract]:As an important legal system to promote scientific and technological progress and innovation, the impact of patents on economic and trade activities has increased significantly, and has become an important indicator to measure the comprehensive strength of countries and regions. Enterprises and other subjects attach great importance to. Patent is an important manifestation of the development of regional science and technology, representing the effect of independent innovation. The transformation of patent technology to real productivity can not only improve production efficiency, but also stimulate economic development. Chongqing is the only municipality directly under the Central Government in the west of China, which leads the development of the western region and plays an important role in the economic development of the western region. After years of development, the amount of patent application and authorization has been greatly improved in Chongqing, but from the perspective of patent quality, the innovation ability and motive force of Chongqing are insufficient, there are many problems in the development of patent industrialization, and patent industrialization is still in its infancy. There are many difficulties. Therefore, how to speed up the development of patent industrialization in Chongqing, promote the development through patent and form scale economy is an important problem that must be solved at present in Chongqing, and it is the only way to develop a strong city with intellectual property rights. First of all, this paper theoretically discusses the connotation and essence of professional vocabulary related to patent industrialization, and points out that patent industrialization refers to the re-development of patent technology and the formation of technology through experiments, combinations, production, application, promotion and so on. Materials, products, and then through the production, commercialization of the form of value, until the process of development into a new industry. There are essential differences between patent implementation, patent transfer, patent transformation and patent commercialization. Secondly, from the situation of patent R & D, patent development, industrialization and the construction of intermediary service system in Chongqing, this paper analyzes the current situation of patent industrialization in Chongqing. The main reasons for the worrying patent industrialization in Chongqing include insufficient investment in R & D, the fact that the enterprise has not become the main body of patent industrialization and the disconnection between the technological achievements of patents and the market in colleges and universities. Finally, according to the theory of collaborative innovation, the necessity of constructing cooperative mechanism of patent industrialization is discussed from three aspects: synergetic motivation, synergistic influencing factors and collaborative framework. It is pointed out that the construction of the cooperative mechanism of patent industrialization will combine all the subjects involved in patent industrialization and stimulate the cooperative power among the subjects in order to promote the promotion of patent industrialization. And put forward some countermeasures and suggestions for the coordinated mechanism of patent industrialization in Chongqing.
