山寨行为中的模仿与戏仿及其法律界限

【摘要】:自“山寨”一词扬名立万之日起,人们对它的评价就褒贬不一,如今的“山寨”早已不是当初小规模的各种模仿组合、投机取巧,已然发展成为一种文化。山寨手机、山寨明星、山寨节目,恰如网友戏言:“忽如一夜春风来,神州无处不山寨”。山寨现象从一个角度折射出中国社会转型时期的生活。改革开放以来,“山寨”现象从无到有、从物到人,逐渐渗透到社会的各个角落,各个领域,无论是速度还是规模都令人咋舌。在感叹“山寨”现象蓬勃发展的同时,人们也在讨论:山寨的大行其道是否是中国创新危机的前兆?是否会对中国知识产权保护造成威胁?本文试图回答的问题是:何为山寨行为?山寨行为因何会堕入侵权的泥淖?法律上应当如何甄别山寨行为的合法与非法? 除去导论和结语,本文分为三部分,第一部分通过典型案例指出山寨侵权的根源,简要说明“山寨现象”由一种经济行为转化为一个社会文化现象的过程,展望其发展趋势。 第二部分、第三部分则是本文的重点。由于“山寨”只是一个模糊的动态的流行词汇,没有确切的定义。多数人认同,“山寨”是模仿的代名词,“山寨文化”是一种模仿文化。“山寨文化”的核心代表是山寨产品,而山寨产品的核心是模仿。模仿行为大量出现在商业领域,判断模仿产品是否侵权,一是看模仿产品的创新程度,二是看该种模仿是否符合“作为科学研究和实验对象使用他人专利产品”。 戏仿作品是指为了对原作品进行讽刺或批判,而对原作品进行“转换性使用”,反映出与原作品作者相对立的观点、立场或思想感情的新作品。戏仿作品是否构成侵权,主要看新作品使用原作品的目的,新作品的性质如何,与新作品相关的引用原作品的数量多少、品质如何,对原作品潜在市场或价值的影响。
[Abstract]:Since the name "shanzhai" has become famous, people have had different opinions on it. Today, it is no longer a small-scale imitation combination, opportunistic, has developed into a culture. Shanzhai mobile phone, Shanzhai star, Shanzhai program, just as netizens joke: "all of a sudden like a night of spring wind blowing, Shenzhou everywhere Shanzhai." The shanzhai phenomenon reflects the life in the period of Chinese social transformation from one angle. Since the reform and opening up, the phenomenon of "shanzhai" from scratch, from material to human, gradually infiltrated into every corner of society, every field, no matter the speed or scale are astounding. While lamenting the vigorous development of the "shanzhai" phenomenon, people are also discussing whether the prevalence of shanzhai is a precursor to China's innovation crisis. Will it pose a threat to the protection of intellectual property rights in China? The question this paper tries to answer is: what is shanzhai behavior? Why did the act of copycat fall into the mud of infringement? How should the law identify the lawfulness and illegality of shanzhai? Apart from the introduction and the conclusion, this paper is divided into three parts. The first part points out the root of Shanzhai infringement through typical cases, briefly explains the process of "shanzhai phenomenon" transforming from an economic behavior to a social and cultural phenomenon, and looks forward to its development trend. The second part, the third part is the focal point of this article. Because "Shanzhai" is only a vague and dynamic popular word, there is no precise definition. Most people agree that Shanzhai is a synonym for imitation, and Shanzhai culture is a kind of imitation culture. The core of "Shanzhai culture" is copycat products, and the core of shanzhai products is imitation. The imitation behavior appears in the commercial field in a large number, judging whether the imitation product is infringing, one is the degree of innovation of the imitation product, the other is whether the imitation conforms to "using other people's patented products as the object of scientific research and experiment". Parody works refer to the new works which are used in order to satirize or criticize the original works and reflect the opposing views, positions or thoughts and feelings of the original works. Whether the parody works constitute infringement mainly depends on the purpose of using the original works, the nature of the new works, the quantity and quality of the cited original works related to the new works, and the influence on the potential market or value of the original works.
