数字环境下版权法定补偿金制度探析

【摘要】：版权法定补偿金制度是著作权保护制度中的一项特别安排，是以德国为代表的大陆法系国家与多数英美法系国家立法实践的产物，在一些知识产权保护水平较高的国家普遍实施。该制度缓和了模拟技术条件下版权人与通过私人复制获得作品的使用人之间的利益紧张关系，达到版权法上的利益平衡。 除去引言和结语部分，本文共三章： 第一章是有关法定补偿金制度的缘起与发展。先介绍了补偿金制度在德国的起源以及发展；然后对该制度进行了理论上的分析，主要是法律属性和内涵以及合理性分析；通过理论上的分析，介绍该制度在其他区各国的广泛运用和实施，并以美国和日本为例介绍了其发展。 第二章是数字时代的版权法定补偿金制度及其应对。首先介绍了数字环境下，补偿金制度面临着理论上的质疑，自身缺陷在实践中的争议，，数字权利管理系统的冲击等挑战；其次分析数字环境下补偿金制度的价值合理性，制度本身的折中性，制度的不可取代性，论述了补偿金制度在数字环境下的重要性；最后论述了补偿金制度在数字环境下的改革和完善，进而提出了补偿金制度应对数字环境挑战的制度之策和技术之策。 第三章是在我国导入补偿金制度的分析。首先阐述了我国导入补偿金制度的必要性；然后通过对我国版权法体系和集体管理的现实性考察，指出我国导入补偿金制度的可行性与不足之处；最后对补偿金制度在我国的建立提出设想，主要从立法模式及运行模式进行阐述。
[Abstract]:The system of legal compensation for copyright is a special arrangement in the system of copyright protection. It is the result of the legislative practice of the countries of the continental law system and the majority of the common law countries represented by Germany. In some countries where the level of intellectual property protection is relatively high, it is generally implemented. The system alleviates the interest tension between the copyright owner and the user who obtains the work through private reproduction under the condition of simulated technology and achieves the balance of interests in copyright law. Apart from the introduction and conclusion, there are three chapters: the first chapter is about the origin and development of the statutory compensation system. First introduced the origin and development of compensation system in Germany, then carried on the theoretical analysis to this system, mainly is the legal attribute and the connotation as well as the rationality analysis, through the theoretical analysis, This paper introduces the wide application and implementation of the system in other countries, and introduces its development with the examples of the United States and Japan. The second chapter is the legal compensation system of copyright in the digital age and its countermeasures. First of all, the paper introduces the challenges of compensation system in digital environment, such as theoretical doubt, disputes about its defects in practice, the impact of digital rights management system, and then analyzes the value rationality of compensation system in digital environment. The paper discusses the importance of the compensation system in the digital environment, and finally discusses the reform and improvement of the compensation system in the digital environment. Furthermore, the paper puts forward the institutional and technical measures for the compensation system to deal with the digital environmental challenge. The third chapter is the introduction of compensation system in China. Firstly, the necessity of introducing compensation system in China is expounded, then the feasibility and deficiency of introducing compensation system in our country are pointed out by investigating the reality of copyright law system and collective management in China. In the end, the author puts forward some ideas about the establishment of compensation system in China, mainly from the legislative model and the operating mode.
