民间文学艺术作品的著作权群体权利主体研究

【摘要】:我国是一个幅员辽阔的多民族国家,民间文学艺术作品琳琅满目,丰富多彩,是民族多样性的集中体现。随着社会的发展,民间文学艺术作品逐渐从传统的使用方式向商业化转变,其极高的艺术价值和商业价值显现出来。由于对民间文学艺术作品的立法一直未能出台,传统的民间文学艺术作品在现代社会没有一个良好的法律环境,由此也导致了很多问题。近年来,关于民间文学艺术作品的著作权纠纷屡见不鲜,其他国家掠夺我国民间文学艺术资源的现象也时有发生,对民间文学艺术作品的立法不应当再止步不前。其中,最大的立法难点就是民间文学艺术作品著作权主体的界定,权利主体的确定是定纷止争、保护和传承民间文学艺术作品的关键所在。本文通过比较研究法、判例研究法、实证分析法等研究方法,在国外立法考察和学者观点分析的基础上,运用知识产权的基本理论对民间文学艺术作品的权利归属进行剖析,认为应当由来源群体对其创作和保有的民间文学艺术作品享有著作权。从民间文学艺术作品的本质属性和特殊性的视角来看,群体权利主体模式不仅具有理论基础,还具有现实可能性,同时来源群体根据种族和地域的双重标准是能够确定下来的。著作权法的诸多基本理念和原则与民间文学艺术作品具有契合性,只要在既有法律框架内进行适度创新和扩张,是完全可以将民间文学艺术作品纳入进来的。民间文学艺术作品作为人类的智力劳动成果,与版权客体具有契合性,不能仅仅因为其创作主体的特殊性而放弃版权法保护。著作权法可以通过赋予来源群体以集体作者身份来承认其著作权主体的地位,并适当创新民事法定代理制度来解决来源群体行为能力缺陷的问题,辅之以利益平衡机制和登记制度。在构建民间文学艺术作品著作权群体权利主体制度时,要尊重来源群体的传统和习惯,突出其精神权利的保护。
[Abstract]:China is a vast multi-ethnic country, folk literature and art works are rich and colorful, is a concentrated embodiment of national diversity. With the development of society, folk literature and art works gradually change from the traditional way of use to commercialization, its extremely high artistic value and commercial value appear. Because the legislation of folklore works has not been enacted, the traditional folklore works in modern society do not have a good legal environment, which also leads to a lot of problems. In recent years, the disputes about the copyright of folk literature and art works are common, and other countries plunder the folk literature and art resources of our country from time to time, so the legislation of folk literature and art works should not stop at the same time. Among them, the biggest legislative difficulty is the definition of the subject of copyright of folklore and art works, the determination of the subject of rights is the key to settle disputes and to protect and inherit the works of folklore and art. Through comparative research, case study, empirical analysis and other research methods, on the basis of foreign legislative investigation and scholars' viewpoint analysis, this paper analyzes the right attribution of folk literature and art works by using the basic theory of intellectual property. The author thinks that the folklore works which should be created and retained by the source groups should be copyrighted. From the perspective of the essence and particularity of folk literature and art works, the mode of subject of group rights has not only theoretical foundation, but also realistic possibility. At the same time, the source groups can be determined according to the double standards of race and region. Many basic ideas and principles of copyright law are consistent with folklore and art works. So long as we make moderate innovation and expansion within the existing legal framework, we can completely bring folk literature and art works into account. As a result of human intellectual labor, folklore and art works are consistent with the copyright object, so we can not give up copyright law protection just because of the particularity of its creative subject. The copyright law can recognize the status of the copyright subject by endowing the source group with the status of collective author, and properly innovate the civil statutory agency system to solve the problem of the defect of the source group's ability to act. It is supplemented by an interest balance mechanism and a registration system. In constructing the subject system of copyright rights of folk literature and art works, we should respect the traditions and habits of the source groups and highlight the protection of their spiritual rights.
