我国中小企业知识产权质押融资探析

【摘要】：进入21世纪以来,我国的中小企业迅速的成长起来,逐渐成为社会经济发展的主力军。但是我国的中小企业长期的缺乏资金支持,严重制约了中小企业的发展。伴随着知识经济时代的不断推进,国际竞争日趋的激烈,国家核心竞争力的竞争逐渐的转变为知识产权资源的竞争。国内外经济发展实践清晰的表明,世界未来的竞争是知识产权的竞争。 虽然现在知识产权质押融资制度在我国发展迅速,尤其是加入WTO以后取得了长足的进步,但是我们也要看到知识产权质押融资制度在我国发展的历史比较短暂,受到中国整体经济社会发展水平和传统思想、文化等多方面因素的制约,社会各界甚至一些知识产权领域的专家都对知识产权质押融资制度了解甚少。所以想要提高我国知识产权质押融资的水平和规模,就要增强公民的产权意识。提高企业和创新主体运用知识产权参与市场竞争,参与市场交易的能力,使更多的中小企业能够获得持续的资金支持,提高企业的竞争能力,促进中国经济的发展。 本文写作的主要目的是在探讨知识产权质权的法律构成的基础上,结合国内外中小企业知识产权质押融资情况,深入分析我国中小企业知识产权质押融资现状,分析产生我国知识产权质押融资现状的原因,通过研究发现,我国现阶段知识产权质押融资有很多问题亟待解决,首先中小企业本身缺少一种产权质押融资的意识,市场参与的热情不足,我国的法律法规对知识产权质押融资方面规定的宽泛,限制了质押融资业务的发展。还有我国的质押融资的基本服务构成和配套设施没有跟上经济发展的步伐,这都大大限制了中小企业知识产权质押融资的发展。通过对一系列因素的分析比较,提出解决问题的方法。本文综合运用了多种的分析问题的方法,运用对比分析法,通过对国内外中小企业知识产权质押融资的分析对比,得出现阶段我国的情况。运用定量分析法,通过对大量数据的综合分析得出结论。运用马克思主义唯物史观和辩证法,分析未来知识产权质押融资的发展趋势。除此之外,还运用了价值分析法,历史分析法等分析方法。本文的创新之处在于对于知识产权质押融资过程的整体把握,从宏观到微观进行分析,从小处,比较容易忽视的地方着眼,在文章最后结合我国社会国情提出了解决问题的方法。
[Abstract]:Since entering the 21 st century, the small and medium-sized enterprises in our country have grown rapidly and become the main force in the development of social economy. However, the long-term lack of financial support for small and medium-sized enterprises in our country has seriously restricted the development of small and medium-sized enterprises. With the development of the era of knowledge economy, the international competition is becoming more and more fierce, and the competition of national core competence is gradually changing into the competition of intellectual property resources. The practice of economic development at home and abroad clearly shows that the future competition of the world is the competition of intellectual property. Although the current system of intellectual property pledge financing has developed rapidly in China, especially after China's accession to the WTO, it has made considerable progress, but we should also see that the history of intellectual property pledge financing system in our country is relatively short. Restricted by the overall level of economic and social development, traditional ideas, culture and other factors, all walks of life and even some experts in the field of intellectual property rights have little knowledge of intellectual property mortgage financing system. Therefore, to improve the level and scale of intellectual property rights pledge financing, we must strengthen citizens' awareness of property rights. To improve the ability of enterprises and innovators to use intellectual property rights to participate in market competition and market transactions, to enable more small and medium-sized enterprises to obtain sustained financial support, to improve their competitiveness and to promote the development of China's economy. The main purpose of this paper is to analyze the current situation of intellectual property pledge financing of small and medium-sized enterprises at home and abroad on the basis of discussing the legal constitution of intellectual property rights pledge and combining the situation of intellectual property pledge financing of small and medium-sized enterprises at home and abroad. By analyzing the reasons for the present situation of intellectual property pledge financing in China, it is found that there are many problems to be solved. Firstly, small and medium-sized enterprises lack a kind of consciousness of property rights pledge financing. The lack of enthusiasm for market participation and the broad regulation of intellectual property mortgage financing in our country limit the development of pledge financing business. Moreover, the basic service composition and supporting facilities of pledge financing in our country have not kept up with the pace of economic development, which has greatly restricted the development of intellectual property mortgage financing for small and medium-sized enterprises. Through the analysis and comparison of a series of factors, the method to solve the problem is put forward. This article synthetically uses many kinds of analysis methods, uses the contrast analysis method, through the domestic and foreign small and medium-sized enterprises intellectual property rights pledge financing analysis contrast, obtains the present situation in our country. By means of quantitative analysis, the conclusion is drawn through the comprehensive analysis of a large number of data. By means of Marxist historical materialism and dialectics, this paper analyzes the development trend of intellectual property pledge financing in the future. In addition, the use of value analysis, historical analysis and other analytical methods. The innovation of this paper lies in the overall grasp of the financing process of intellectual property rights pledge, from macro to micro analysis. At the end of the article, the author puts forward the methods to solve the problem in the light of the social conditions of our country.
