佛山陶瓷产业知识产权法律保护研究

【摘要】：佛山陶瓷产业历史悠久，经过多年发展，尤其是改革开放后的强势崛起，现佛山已成为全国乃至全球最大的陶瓷生产基地，“佛山陶瓷”享誉海内外，并于2013年获国家工商总局批准成为集体商标。同年，3月26日国家知识产权局、工业和信息化部、工商总局、版权局四部委下发《关于加强陶瓷产业知识产权保护工作的意见》，该意见将陶瓷产业知识产权保护工作提到新的高度。在国家出台意见加强陶瓷产业知识产权保护的新形势下，审视佛山陶瓷产业知识产权保护会发现佛山陶瓷产业知识产权法律保护面临存在大量著作权、商标权、专利权的侵权行为和地理标志保护不力的问题。在我国双轨制的知识产权保护模式下，表现出行政保护机制不畅，，司法保护作用受限，行业协会作用有限的问题。此外，佛山陶瓷行业还存在对佛山陶瓷文化遗产的保护认识不足，对知识产权保护中环境保护关系缺乏清晰的认识的问题。本文在对上述佛山陶瓷产业知识产权工作的基本情况进行研究的基础上，分析了存在的问题及原因，提出利用现有法律保护佛山陶瓷产业的知识产权，进一步完善佛山陶瓷产业知识产权法律保护机制，注重和推进佛山陶瓷文化遗产的知识产权保护、实现陶瓷产业知识产权保护与环境保护的有机统一等方面入手加强佛山陶瓷产业知识产权保护的对策和建议。
[Abstract]:Foshan ceramic industry has a long history, after years of development, especially after the strong rise of reform and opening up, now Foshan has become the largest ceramic production base in the country and even the world, "Foshan Ceramics" is well known at home and abroad. And in 2013 by the State Administration of Industry and Commerce approved to become a collective trademark. The same year, 26 March, State intellectual property Office, Ministry of Industry and Information, General Administration of Industry and Commerce, Opinions on strengthening the Protection of intellectual property Rights of Ceramic Industry were issued by four ministries and commissions of copyright Bureau, which raised the protection of intellectual property rights of ceramic industry to a new height. Under the new situation of the state's opinions on strengthening the protection of the intellectual property rights of the ceramic industry, a review of the protection of the intellectual property rights of the Foshan ceramic industry will find that there are a large number of copyright and trademark rights in the legal protection of the intellectual property rights of the Foshan ceramics industry. Infringement of patent rights and inadequate protection of geographical indications. Under the dual track system of intellectual property protection in our country, the administrative protection mechanism is not smooth, the judicial protection function is limited, and the role of trade associations is limited. In addition, Foshan ceramic industry still has insufficient understanding of the protection of Foshan ceramic cultural heritage and lack of clear understanding of the relationship between environmental protection and intellectual property protection. On the basis of studying the basic situation of the intellectual property work of Foshan ceramics industry, this paper analyzes the existing problems and causes, and puts forward that the existing laws should be used to protect the intellectual property rights of Foshan ceramics industry. To further improve the legal protection mechanism for the intellectual property rights of the Foshan ceramics industry, and to pay attention to and promote the protection of intellectual property rights of the Foshan ceramic cultural heritage, The countermeasures and suggestions to strengthen the protection of intellectual property rights in Foshan ceramics industry are put forward in order to realize the organic unification of intellectual property protection and environmental protection in ceramic industry.
