专利功能性限定特征权利要求解释冲突问题研究

【摘要】：专利权是近代法律创新的重要成果之一，专利制度的建立创设了一种全新的财产权利，专利制度的正常运行可以起到“为天下之火添加利益之油”的作用。但是，近代几乎所有学者都认为，权利要求保护范围才是专利制度的精髓。1从专利申请、专利审查到专利保护，都是围绕专利权利要求而进行的。2 我国专利法规定，一项发明或实用新型的技术方案才是权利要求书的基础。3特殊情况下，专利发明过程中的目的，实施的效果，也会被用来解释权利要求书，功能性限定特征就是这样应运而生的。那么，究竟何为功能性限定特征？一般来说，，是指在一项权利要求中用来限定发明的是零部件在发明中所产生的目的，或者步骤在发明中的效果，而不是特殊的结构或者步骤。 我国国家知识产权局依据《审查指南》对功能性限定特征做出了自己的解释，而最高人民法院则依据相关司法解释给出了自己的理解，两种不同的解释方式给社会带来了极大的困扰，公众和专利权人的利益得不到有效保护，《专利法》的严肃性受到严重挑战。4因此，对于专利功能性限定特征权利要求解释冲突问题进行研究，无论在理论上，还是司法实践上，都具有重大的意义。 本文一共分为四个部分： 第一章对我国专利功能性限定特征权利要求解释出现的问题进行了分析和阐述，针对功能性限定特征的定义、存在的原因以及对相关方面的不利影响做出了全面描述。 第二章详细阐述了了美国、欧盟、日本、国际条约对于功能性限定特征权利要求解释在理论和实践中的显著差异。 第三章采用比较法的分析方法，重点分析了美国、欧盟、日本、国际条约对于功能性限定特征权利要求解释适用规则的不足。 第四章，通过前三章的论述，同时借鉴美国、欧盟、日本、国际条约在此问题上的观点，提出了解决我国专利功能性限定权利要求解释冲突问题的建议。
[Abstract]:Patent right is one of the important achievements of modern law innovation. The establishment of patent system has created a new property right, and the normal operation of patent system can play the role of "adding benefit oil for the fire of the world". However, almost all modern scholars believe that the scope of protection of claims is the essence of the patent system. 1 from patent application, patent examination to patent protection, it is carried out around patent claims. A technical scheme of an invention or utility model is the basis of a claim of rights. 3 in special cases, the purpose and effect of the patent invention process will also be used to explain the claim, This is how functional defining features emerge as the times require. So, what exactly is a functional qualification feature? Generally speaking, what is used in a claim to define the purpose of the invention is the purpose of the parts in the invention, or the effect of the steps in the invention, rather than the special structure or step. The State intellectual property Office of China has made its own interpretation of the functional limitation characteristics according to the "Review Guide", while the Supreme people's Court has given its own understanding according to the relevant judicial interpretations. Two different ways of interpretation have brought great trouble to society, the interests of the public and patentees are not effectively protected, and the seriousness of the Patent Law is seriously challenged. It is of great significance both in theory and in judicial practice to study the conflict of interpretation of patent functional defined features. This paper is divided into four parts: the first chapter analyzes and expounds the problems in the interpretation of functional qualification feature claims in China, aiming at the definition of functional defined features. The reasons for the existence and the adverse effects of the related aspects are described in a comprehensive way. The second chapter elaborates the significant differences between the theory and practice of the interpretation of the functional defined feature claims in the United States, the European Union, Japan and international treaties. In the third chapter, the comparative method is used to analyze the deficiency of the applicable rules for the claims of functional defined characteristics in the United States, the European Union, Japan and international treaties. The fourth chapter, through the discussion of the first three chapters, at the same time draw lessons from the views of the United States, the European Union, Japan and international treaties on this issue, and put forward some suggestions to solve the conflict of patent functional limitation claims in China.
