论计算机游戏著作权的整体保护

【摘要】:计算机游戏产业通过近些年的迅猛发展已经具有极大的市场规模,拥有十分庞大的游戏人群。激烈的市场竞争促使更多的侵权行为发生,我国知识产权法相关法律更加侧重对计算机游戏代码和运算程序的保护,对于表达层面的保护几乎无能为力。在著作权侵权行为的判定中,往往将计算机游戏拆分成程序、文学作品、美术作品、音乐作品、电影作品等多种作品分别进行判定,割裂了计算机游戏的整体性,增加了诉讼成本,也不利于游戏产业健康发展。
[Abstract]:The computer game industry through the rapid development in recent years has a huge market scale and a very large number of game people. The fierce market competition promotes more infringement, and the law of intellectual property law in our country lays more emphasis on the protection of computer game code and arithmetic program, which is almost powerless for the protection of expression level. In the judgment of copyright infringement, computer games are often divided into programs, literary works, fine arts works, music works, film works and other works, which separate the integrity of computer games. Increased litigation costs, also conducive to the healthy development of the game industry.
