网络经济中滥用市场支配地位的法律规制研究

【摘要】:科学技术的进步与网络知识的普及促使网络经济突飞猛进的发展,但同时我们也应当看到网络经济中滥用市场支配地位新问题的出现。2010年腾讯QQ与奇虎360一系列竞争行为的发生引发了人们对规制滥用市场支配地位法律的重新思考。 腾讯公司实施的强制客户安装电脑管家的行为与逼迫客户“二选一”的行为是否属于滥用市场支配地位的行为在司法界和学术界与实务界有着不同的看法,本案涉及法律问题较多,本文仅从法律角度围绕腾讯QQ与奇虎360的案例研究以下问题:第一,为什么我国滥用市场支配地位的法律制度不能规制腾讯QQ与奇虎360之间的竞争行为?第二,为什么我国的反垄断执法机构没有规制腾讯QQ滥用市场支配地位的行为?第三,为什么是在工信部和公安部的行政干预下腾讯QQ与奇虎360恢复兼容?第四,如何正确协调处理保护知识产权与反对垄断之间的关系? 本文核心内容分为四部分:第一部分对网络经济中滥用市场支配地位的基础理论进行阐述,包括网络经济的含义和特征、网络经济中滥用市场支配地位的构成要件,网络经济中滥用市场支配地位的表现形式及其特殊性、必要性等基础理论,为后文分析网络经济中滥用市场支配地位的行为打下理论基础;第二部分包括我国网络经济中规制滥用市场支配地位的现状分析及其存在的问题,阐述网络经济中规制滥用市场支配地位的立法现状及其现实社会中法律的实施状况,分析我国网络经济中规制滥用市场支配地位存在的问题;第三部分介绍国外网络经济中规制滥用市场支配地位的相关制度,包括美国的三倍损害赔偿制度、刑事法律手段打击滥用行为等;第四部分提出规制我国网络经济中滥用市场支配地位的几点建议,包括规制网络经济中滥用市场支配地位的整体规划,完善责任主体范围,完善监管组织机构的设想,合理分配举证责任,加大行政责任的处罚力度,增加刑事责任承担方式,协调反垄断法与知识产权保护的关系,加强中国互联网协会行业自律监管。本文的不足之处在于并未对相关市场的界定、相关市场的支配地位以及相关市场是否存在滥用行为等理论进行详细的讨论。
[Abstract]:The progress of science and technology and the popularization of network knowledge promote the rapid development of network economy. But at the same time, we should also see the emergence of new problems of abuse of market dominance in the network economy. The occurrence of a series of competition behaviors between Tencent QQ and Qihoo 360 in 2010 caused people to rethink the law of regulating abuse of market dominant position. Tencent's behavior of forcing customers to install PC manager and forcing customers to "choose one from two" behavior is a behavior of abusing the dominant position of the market. There are different views in the judicial and academic circles and between the practical circles and the judicial and academic circles. There are many legal issues involved in this case. This article only focuses on the case studies of Tencent QQ and Qihoo 360 from a legal point of view. The following issues are discussed: first, Why can't the legal system of abusing market dominance in China regulate the competition between Tencent QQ and Qihoo 360? Second, why does China's anti-monopoly law enforcement agencies not regulate Tencent QQ abuse of market dominance behavior? Third, why did Tencent QQ and Qihoo 360 resume compatibility under the administrative intervention of the Ministry of Industry and Information Technology and the Ministry of Public Security? Fourth, how to correctly coordinate the relationship between the protection of intellectual property rights and anti-monopoly? The core content of this paper is divided into four parts: the first part expounds the basic theory of abuse of market dominant position in network economy, including the meaning and characteristics of network economy, and the constituent elements of abusing market dominant position in network economy. The basic theory of abusing market dominant position in network economy, such as its form, particularity and necessity, lays a theoretical foundation for analyzing the behavior of abusing market dominant position in network economy. The second part includes the analysis of the current situation of the regulation and abuse of market dominance in the network economy of our country and the existing problems, and expounds the legislative status of the regulation of the abuse of the market dominance in the network economy and the implementation of the law in the real society. This paper analyzes the problems existing in the regulation and abuse of the dominant position of the market in the network economy of our country. The third part introduces the related system of regulating the abuse of market dominance in the foreign network economy, including the triple damages system in the United States, criminal legal means to combat abuse and so on. The fourth part puts forward some suggestions to regulate the abuse of market dominance in the network economy of our country, including the overall plan of regulating the abuse of market dominance in the network economy, perfecting the scope of the subject of responsibility and perfecting the regulatory organization. We should allocate the burden of proof rationally, strengthen the punishment of administrative responsibility, increase the way of assuming criminal responsibility, coordinate the relationship between anti-monopoly law and intellectual property protection, and strengthen the self-regulation of Chinese Internet Association industry. The deficiency of this paper is that there is no detailed discussion on the definition of the relevant market, the dominant position of the relevant market and the existence of abuse in the relevant market.
