知识产权保护对农产品出口贸易影响研究

【摘要】：知识经济的迅速发展使知识产权保护变得日益重要,当全球性贸易逐步与知识产权密切结合,并以技术贸易、知识产权贸易等形式呈现后,知识产权保护工作开始在国际范围内进行。据联合国粮农组织统计,在2011至2013期间仍有8.42亿世界人口处于饥饿的边缘,农产品国际贸易的有序发展在解决人类粮食安全问题方面发挥着至关重要的作用,因此农产品贸易中的知识产权保护问题更值得我们深入地探讨与研究。文章首先从知识产权的基本问题出发,阐述了知识产权的理论基础、特征以及现有的国际和国内保护体系,分析了知识产权保护的静态和动态双重经济效应；论文论述了农产品知识产权保护制度的特点,以及对于农产品贸易量和贸易利益的影响。着重阐述了农产品知识产权保护的重要内容之一—植物新品种权保护。以《国际植物新品种保护联盟公约》和《与贸易有关的知识产权协定》为例全面呈现了植物新品种权国际保护体系,分析其意义和对发达国家、发展中国家各方面的不同影响。论文实证部分以植物新品种权保护情况为例,通过引入贸易引力模型,分析植物新品种权保护对主要国家农产品出口贸易的影响,从而考察农产品知识产权保护对农产品出口贸易的作用。从模型的回归结果看,无论是农产品出口国实施农产品知识产权保护还是其出口贸易对象国实施农产品知识产权保护,都能够有效地促进该国农产品出口贸易的发展。
[Abstract]:With the rapid development of knowledge economy, the protection of intellectual property rights has become increasingly important. After the global trade is closely integrated with intellectual property rights, and presents in the form of technology trade, intellectual property trade and so on, The protection of intellectual property rights has begun to be carried out in the international scope. According to statistics from the Food and Agriculture Organization of the United Nations, 842 million of the world's population was still on the verge of hunger between 2011 and 2013, and the orderly development of international trade in agricultural products played a vital role in solving the problem of human food security. Therefore, the protection of intellectual property rights in agricultural trade is more worthy of our in-depth discussion and research. Starting from the basic problems of intellectual property rights, this paper expounds the theoretical basis, characteristics and existing international and domestic protection systems of intellectual property rights, and analyzes the static and dynamic dual economic effects of intellectual property protection. This paper discusses the characteristics of intellectual property protection system of agricultural products and its influence on the trade volume and interests of agricultural products. This paper focuses on the protection of new plant varieties rights, which is one of the important contents of intellectual property protection of agricultural products. Taking the Convention of the International Union for the Protection of New Plant varieties and the Agreement on Trade-related intellectual property Rights as examples, the international protection system of plant new varieties rights is presented comprehensively, and its significance and different effects on developed and developing countries are analyzed. In the empirical part of the paper, taking the protection of plant new variety rights as an example, through the introduction of trade gravity model, this paper analyzes the impact of plant new variety rights protection on the export trade of agricultural products in major countries. In order to investigate the role of intellectual property protection of agricultural products on agricultural export trade. According to the regression results of the model, both the protection of intellectual property rights of agricultural products in the exporting countries of agricultural products and the protection of intellectual property rights of agricultural products in the target countries of their export trade can effectively promote the development of the export trade of agricultural products in that country.
