【摘要】：我国作为一个拥有13亿人口的大国，稳定是做好一切工作的基础，农业稳则社会安，而土地问题又是农业问题的核心，“三农问题”处理的好坏关键在土地问题的解决。随着人口老龄化，特别是农村人口老龄化问题日益严重，农村劳动力匮乏，农村留守儿童等社会问题逐步凸显，农村土地规模抛荒呈现扩大趋势，土地生产力下降，管理水平落后，特别是我国农业发展存在着先天性的人均农地占有量低、条块分割等障碍，严重影响了农业生产效率。新中国成立以来，我国土地制度经历了农民个体所有、自主经营，集体所有、集体经营到集体所有、个体经营的变迁。特别是改革开放以来的家庭联产承包责任制极大提高了农业生产力，我国用仅占世界7%的耕地养活了占世界23%的人口。随着经济的高速发展，我国农业小规模、粗放式和零碎化的传统生产方式已经不能适应当今社会的实际需求，逐步出现了代耕、出租、转包、转让、“反租倒包”、土地合作社和土地股份合作制等土地流转方式，在一定程度上促进了农业集约化、规模化和现代化生产，，很大程度上提高了农村土地生产力和农民收入，但同时这些流转方式的弊端也逐步显现，创新土地流转方式的需求迫切。本文全方位、多层次的分析了我国农村土地信托模式，在现行土地流转面临困境，主要流转方式运用弊端逐步凸显的背景下，为农村土地信托的运用提供了广阔的空间，本文在研究和分析的基础上构建了具有中国特色的农村土地信托流转模式，并通过引入博弈模型对土地信托机构存在的选择行为进行激励约束，最大限度保障委托方的利益。
[Abstract]:China is a country with a population of 1 billion 300 million, stability is the basis of doing all the work of agriculture, social security is stable, and the land problem is the core problem of agriculture, "three rural issues" is the key in the process of solving the land problem. With the aging of the population, especially the rural population aging problem is becoming more and more serious the rural labor force, lack of rural left-behind children and other social problems gradually highlight the scale of land of rural land has a tendency to expand, the decline of land productivity, backward management level, especially the agricultural development of our country has congenital per capita possession of the low land, fragmentation and other obstacles, seriously affect the efficiency of agricultural production.
Since the new Chinese was established, the land system of our country has experienced all the independent management, individual farmers, collective ownership, collective management to collective ownership, changes in individual business. Especially since the reform and opening up of the household contract responsibility system has greatly improved the agricultural productivity in China accounted for only 7% of the world's arable land to feed 23% of the world the population. With the rapid development of economy, small scale agriculture in our country, and the extensive fragmentation of the traditional mode of production has been unable to meet the actual needs of today's society, the gradual emergence of the contract, rental, subcontracting, transfer, "anti rent Daobao, land cooperatives and land joint-stock cooperative system of land circulation, promote agriculture intensive to a certain extent, scale and modernization of production, greatly improve the productivity of rural land and farmers' income, but also disadvantages of these transfer methods have gradually emerged, innovative soil The demand for the mode of land transfer is urgent.
In this paper, all-round, multi-level analysis of the mode of rural land trust in our country, in the current land use problems facing difficulties, gradually highlight the background main circulation mode, provides a broad space for the use of the trust of rural land, this paper constructed with Chinese characteristics of rural land trust management based on research and analysis and, by selecting the behavior into the game model of the land trusts the existence of incentive and constraint, to maximize the protection of the interests of clients.
