经济转型背景下我国利用外资的法律规制研究

【摘要】：在经济发展的不同阶段,对外资的法律规制也会呈现出不同的内容和模式,当前我国外资法律规制工作的重心是外资立法体系的完善。适应国际投资立法出现的自由化趋势,结合我国外资法律规制及外资立法体系存在的问题,本文提出规制外资与完善我国外资立法体系的思路,即确立外资立法的"资本本位",建立一个以统一外资法法典为核心,以有关外资的配套法律规范为补充,以其他落实外资法律的行政法规为具体指导,具有统一性和高透明度的和谐高效的外资法体系。
[Abstract]:In different stages of economic development, the legal regulation of foreign capital will also present different contents and models. At present, the focus of the legal regulation of foreign capital in China is the perfection of foreign capital legislation system. According to the trend of liberalization of international investment legislation and the problems existing in China's foreign investment legal system, this paper puts forward the ideas of regulating foreign capital and perfecting our country's foreign investment legislation system. That is, to establish the "capital standard" of foreign capital legislation, to establish a foreign investment law code as the core, to supplement the supporting legal norms on foreign investment, and to take other administrative regulations to implement foreign capital laws as the specific guidance. A harmonious and efficient foreign capital law system with unity and high transparency.
