互联网支付反洗钱监管研究

【摘要】：随着互联网金融的不断深入,网上汇款、购物、理财等已经成为人们生活的常态。互联网时代,洗钱方式也随之发生了变化,传统的反洗钱监管已无法全面覆盖。互联网支付凭借其隐蔽性、即时性和全球化等特点,成为洗钱者广泛运用的新手段,对反洗钱工作提出了新挑战。虽然我国新近将互联网支付纳入了监管对象,但针对反洗钱的相关配套制度和措施尚在完善中,且由于互联网支付新技术、新业务不断被开发,其反洗钱工作始终处于滞后状态,相关的研究工作和制度建设亟待加强。本文从互联网支付洗钱的概念入手,介绍了互联网支付、洗钱、互联网支付洗钱的基本概念和现状,对互联网支付洗钱的主要方式和特点进行了梳理,总结了我国互联网支付洗钱的起源和发展现状,从更易隐藏身份、交易速度更快、跨区域转移更方便、成本低收益高四方面对互联网支付洗钱的诱因进行了分析,结合相关国际经验和笔者的工作实践,从制度建设、机构设置、协作机制等六方面对我国互联网支付反洗钱监管体系进行了分析,评价了监管覆盖面、制度适用性等方面的成效和存在的问题,提出了完善监管制度、转变监管思路、丰富监管手段等打击互联网支付洗钱犯罪的监管建议。本文提出的建议是在充分理论研究和工作实践的基础上得出,具有一定的操作性和实践性。
[Abstract]:With the development of Internet finance, online remittance, shopping and financial management have become the norm of people's life. In the Internet era, money laundering has changed with it, and the traditional anti-money-laundering regulation can not be completely covered. Internet payment, with its characteristics of concealment, immediacy and globalization, has become a new means widely used by money launderers, and has posed a new challenge to the work of anti-money laundering. Although China has recently brought Internet payment into the regulatory object, the relevant supporting systems and measures for anti-money laundering are still in the process of being perfected, and new business has been continuously developed because of the new technology of Internet payment. Its anti-money-laundering work is always lagging behind, and relevant research work and system construction need to be strengthened. This paper begins with the concept of Internet payment money laundering, introduces the basic concepts and present situation of Internet payment, money laundering and Internet payment money laundering, and combs the main ways and characteristics of Internet payment money laundering. This paper summarizes the origin and development of Internet payment money laundering in China, analyzes the inducements of Internet payment money laundering from four aspects: easier to hide identity, faster transaction speed, more convenient transregional transfer, higher cost and lower income. Combining with the relevant international experience and the author's work practice, this paper analyzes the anti-money laundering supervision system of Internet payment in China from six aspects, such as system construction, institution setting and cooperation mechanism, and evaluates the supervision coverage. This paper puts forward some suggestions on how to perfect the supervision system, change the idea of supervision, enrich the means of supervision, and so on, in order to combat the crime of money laundering on the Internet. The suggestions made in this paper are based on the full theoretical research and work practice, and have some maneuverability and practicability.
