试析公示性公告的文体理据及行文问题

【摘要】：内容的确定性不是公告的文体属性,信息确定与否不构成公告和公示的本质区别,以公告发布公示信息有充足的文体理据,党政机关对外正式发布重要的公示事项应以公示性公告行文。公示不具备法定公文的特定效力和规范体式,不应越位侵袭公告的文体功能和行文领域,公示的"法定公文化"倾向应予以警惕。公示性公告的使用必须严守文体规范而不逾功能界限,党政机关内设机构不具备对外正式发文的权限,不应越位制发公示性公告。公示性公告与公示性通告、公示性通知都是合理可行的公文种类,各有其特定的功能定位和明确的文体边界,三者之间是相对独立而又彼此互补的共生关系。
[Abstract]:The certainty of the content is not the stylistic attribute of the public announcement, and whether the information is confirmed or not does not constitute the essential difference between the public announcement and the public announcement.Party and government organs should publish important public affairs with public announcement.Public notice does not have the specific effect and normative style of legal document, it should not offside attack the stylistic function and writing field of public notice, and the tendency of public notice "legal public culture" should be guarded.The use of publicity announcements must strictly abide by the stylistic norms and not exceed the functional limits. The internal organs of the Party and government organs do not have the authority to issue official documents to the outside world, and they should not issue public announcements offside.Public announcement, public notice and public notice are all reasonable and feasible types of official documents, each has its specific functional orientation and clear stylistic boundary, the three are relatively independent and complementary symbiotic relationship.
