《党政机关公文处理工作条例》解读

【摘要】:中共中央办公厅于2012年4月16日发布了《党政机关公文处理工作条例》,并于2012年7月1日起正式施行。《党政机关公文处理工作条例》的执行,宣告了中共中央办公厅于1996年5月3日发布的《中国共产党机关公文处理条例》和国务院于2000年8月24日发布《国家行政机关公文处理办法》正式退出历史舞台。作为新《条例》的配套,同年6月29日国家质监总局和国家标准化委员会发布了《党政机关公文格式》国家标准,于7月1日正式实施,1999年修订实行的《国家行政机关公文格式》即行停止实施,,这宣告了我国党政机关公文处理统一的新时代正式到来。 为较好的贯彻学习新文本,纠正文书工作者与新文本的规定不相适应的地方,同时也为了进一步领会新文本的进步之处,并查找出新文本仍然不合理的因素,为下一步的继续修订提出可供参考的建议,笔者选取这五个文本,从公文处理的总原则以及公文拟制、公文办理、公文管理的流程进行了比较研究。 文章认为,新文本的修订有许多创新之处,如:更加注重公文处理的科学化,更好的把握了“党政合一”和“党政分开”的原则,对党政机关公文进行了界定,对文种数量进行了精简,对文种功能进行了拓展、限制和综合,进一步规范了文本语言的表述,对条例和格式的内容进行了校好的区分,对行文规则和处理流程进行了进一步的梳理,进一步加强了对公文管理的规定和要求等等。 当然,通过比较研究,笔者发现了新文本仍存在一些不足之处。如:个别文种的适用范围不够科学合理;未认识到公文传递的重要性,对公文处理流程的科学划分还有待进一步明确和梳理;公文拟制环节中,对“审核”“审议”“初核”的概念规定较为模糊等等。 新文本的颁布和实施,对于党政机关实际公文处理工作是一次挑战和革新,要求公文处理工作者全面学习领会文本内容和要求,并通过实践进行检验,进一步提高公文处理工作的质量和效率。
[Abstract]:The General Office of the CPC Central Committee issued the regulations on the handling of official documents of Party and Government organs on 16 April 2012, and the implementation of the regulations on the handling of official documents of Party and Government organs came into effect on 1 July 2012, The regulations on the handling of official documents of the organs of the Communist Party of China, issued by the General Office of the CPC Central Committee on May 3, 1996, and the measures for handling official documents of the State Administrative organs, issued by the State Council on August 24, 2000, were officially withdrawn from the historical stage. As a complement to the new regulations, on 29 June of the same year, the State Administration of quality Supervision and the State Standardization Commission issued the national standard "format of official documents of Party and Government organs", which was officially implemented on 1 July. The "official document format of State Administrative organs", which was revised and carried out in 1999, ceased to be implemented, which proclaimed the arrival of a new era of unified handling of official documents of the Party and Government organs in China. In order to better carry out the study of the new text, correct the incompatibility between the clerks and the provisions of the new text, and at the same time in order to further understand the progress of the new text and find out the factors that remain unreasonable in the new text, In order to make suggestions for further revision, the author selects these five texts and makes a comparative study on the general principles of document processing, the preparation of official documents, the management of official documents and the management of official documents. The article holds that there are many innovations in the revision of the new text, such as paying more attention to the scientific handling of official documents, better grasping the principles of "the unity of party and government" and "separating the party and government", and defining the official documents of the party and government organs. It simplifies the number of languages, expands, limits and synthesizes the functions of the language, further standardizes the expression of the text language, and makes a good distinction between the contents of the regulations and the format. The rules of writing and processing process are further combed, and the regulations and requirements of document management are further strengthened. Of course, through the comparative study, the author found that there are still some shortcomings in the new text. For example, the scope of application of individual languages is not scientific and reasonable, the importance of document transmission has not been recognized, the scientific division of the processing process of official documents needs to be further clarified and combed; In the process of document preparation, the definition of "audit", "review" and "preliminary audit" is vague and so on. The promulgation and implementation of the new text is a challenge and innovation for the actual processing of official documents of the party and government organs, requiring the official document processing workers to learn and understand the contents and requirements of the text in an all-round way, and to test it through practice. Further improve the quality and efficiency of document processing.
