【摘要】：数字技术的发展丰富了作品的传播方式,任何作品都可以转化成数字化的形式进行传播。与传统的作品传播方式相比较,数字化的传播方式具有综合性、交互性及高效性等特征。数字化传输动摇了复制权的基础地位,控制传播比控制复制具有更大的意义。针对数字技术的发展对现有著作权制度的冲击,各国立法均有不同程度的回应。我国2001年《著作权法》修改中特别增加了信息网络传播权及2006年颁布了《信息网络传播权保护条例》以适应数字技术对我国的著作权体系的冲击。 我国当前《著作权法》赋予作者著作财产权包括复制权、发行权、传播权及演绎权。传播权包括展览权、表演权、放映权、广播权和信息网络传播权,5种权利共同构成我国传播权的整体架构。数字技术及网络技术的发展,作品通过网络途径进行传播在相当程度上模糊了著作财产权之诸传播权间的界限,表现为传播权内部子权利之间出现了边界模糊,内容重合情形。一些权利的设置非常多余,而许多应该纳入传播权保护的内容却游离于法律之外,这种传播权的格局显然不能适应技术发展对传播权结构性完善的需要。 传播权整合是著作权体系化的需要,是我国著作权法新一轮修改的最佳路径,也是文化产业发展的需要。数字技术的发展也给传播权整合提供了可能性,只有整合当前传播权的格局才能够协调权利之间的冲突与重合现象。传播权整合的理论基础在于权利边界的划定和权利束的定位,只有明确了各项权利的边界才能进行权利整合。传播权的整合具有很重要的现实意义,传播权整合能保持现有法律制度的相对稳定,整合后的制度增强了法律的操作性,便于司法活动的开展,通过权利整合完善传播权制度,有利于文化产业繁荣发展。 传播权整合的过程中要坚持利益平衡的原则和技术中立的原则。技术发展打破了原有的利益平衡,数字环境下,需要在整合中重新确认各方的利益机制。著作权制度的发展与传播技术的进步息息相关,技术立法或者修改法律应始终坚持利益平衡的原则。传播权具体整合应该以我国现有的法律制度为基础。传播权整合的具体思路为：设立一个与复制权和发行权平行的总权利——传播权,将未纳入法律保护的网络广播和网络直播整合入广播权。将表演权和放映权整合为一个权利,保持信息网络传播权的稳定,删除展览权。论文在上述思路的基础上提出了《著作权法》的修改意见。
[Abstract]:The development of digital technology rich mode of transmission of the works, any work can be converted into digital form of communication. Compared with the traditional work mode of transmission, digital communication has a comprehensive, interactive and efficient characteristics. China's current "Copyright Law > gives authors property rights include copy right, distribution right, the right of communication and interpretation of the right. The right of communication including the right of exhibition, performance rights, theatrical rights, broadcast rights and the right to network dissemination of information, 5 kinds of rights constitute the whole framework of our right of communication. The development of digital technology and the network technology, the spread of the fuzzy boundaries of works copyright to a considerable extent of the spread through the network way right between the performance of the right of communication between internal sub the right boundary is fuzzy, content overlap situation. Some of the rights set very redundant, and many should be included in the protection of the right of communication content is free from the law besides, the right of communication pattern obviously can't adapt to technology development and structural improvement of the right of communication needs.
The right of communication integration is the need of the copyright system is the copyright law in our country a new round of revision of the best path, but also to the development of cultural industry. The development of digital technology to the right of communication integration provides the possibility of integration, only the pattern of the right of communication to coordinate the conflict between the right and the coincidence phenomenon. The theoretical basis of the right of communication integration is designated the right boundary and right beam positioning, only clear the rights boundary to right integration. It has very important practical significance to integrate the dissemination right, the right of communication integration to maintain the existing legal system is relatively stable, after the integration of the system enhances the operability of the law. To facilitate judicial activities, through the right to improve the integration of the right of communication system, is conducive to the prosperity and development of cultural industry.
