我国典当立法问题浅谈

【摘要】：改革开放后，我国典当业逐步复苏，典当被赋予了新的内涵。然而随着社会经济条件的改变，，新时期的典当给传统民法理论和司法实践带来严峻的挑战。因此，再次研究典当问题特别是典当立法问题具有重大意义。本文基于目前我国典当业发展现状，结合传统民法理论，从典当的内涵、特征、历史发展、法律关系等方面对典当理论作一些探讨。作者从典物的范围入手，参照世界其他国家典当的概念，提出了自己的观点，并且认为典当法律关系具有物权属性，典当是一种特殊的物权，其客体应该包括动产、财产权利和不动产。与典当业的快速发展相对比，我国的典当立法进展比较缓慢。目前规范典当行业的法律存在着许多问题，如典当立法层次和效力偏低、典当重要规定缺失、典当规定之间存在冲突、监督管理机制不健全等等。正因为如此，本文对我国典当立法与典当活动中存在的问题提出了建议，主要包括制定完善统一的典当法、补充我国典当立法缺失内容、放宽对典当行的一些规定、对典当业加强监督管理等。希望未来典当立法能够在现在的基础上进行完善，从而推动我国典当业的健康有序发展。
[Abstract]:After reform and opening up, the pawnbroking industry recovers gradually, and pawnshop is endowed with new connotation. However, with the change of social and economic conditions, pawning in the new period has brought severe challenges to the traditional civil law theory and judicial practice. Therefore, it is of great significance to study the pawn problem again, especially the pawn legislation. Based on the present situation of pawnbroking in China and the traditional civil law theory, this paper discusses the pawn theory from the aspects of its connotation, characteristics, historical development, legal relationship and so on. Starting from the scope of the classic, the author puts forward his own viewpoint with reference to the concept of pawn in other countries in the world, and holds that the legal relationship of pawn has the property of real right, and pawn is a special kind of real right, the object of which should include movable property. Property rights and immovable property Compared with the rapid development of pawnbroking, the legislation of pawn in our country is relatively slow. At present, there are many problems in regulating the law of pawn industry, such as the low level and effectiveness of pawn legislation, the absence of important provisions of pawn, the conflict between pawn regulations, the imperfect supervision and management mechanism, and so on. For this reason, this paper puts forward some suggestions on the problems existing in the legislation and activities of pawn in China, mainly including the establishment of a unified pawn law, the supplement of the missing content of the pawn legislation in our country, and the relaxation of some regulations on pawn shops. Strengthen supervision and management of pawnbroking. Hope that the future pawn legislation can be perfected on the basis of the present, thus promoting the healthy and orderly development of China's pawn industry.
