金融调控与监管的差异性及金融法审视

【摘要】：金融调控和金融监管构成金融调制行为,二者也构成金融调制行为内部矛盾的两个方面。金融调控与金融监管在宏观与微观两个层面都存在着显著的纵向差异。在审视金融立法时,应看到正是由于现行立法对金融调控和监管两种法律行为厘定不清,使二者要么错位重叠,要么缺失、越位。有鉴于此,从金融法层面作出积极回应就成为必然。
[Abstract]:Financial regulation and supervision constitute financial modulation behavior, and they also constitute two aspects of internal contradiction of financial modulation behavior. There are significant vertical differences between financial regulation and financial regulation at macro and micro levels. When examining the financial legislation, we should see that it is precisely because the current legislation has not clearly defined the two legal acts of financial regulation and supervision, that the two laws are either misplaced or overlapped, or lacking or offside. In view of this, a positive response from the level of financial law becomes inevitable.
