基于旅游法的河南省旅游购物环境研究

【摘要】:旅游业作为一个新兴的产业,虽然起步较晚,但随着国民经济的快速发展和运行,旅游业以其独特的生命力和发展潜力快速向前发展,取得的经济效益日益增强。旅游购物作为旅游的一个体验环节,其购物过程的愉悦程度将会影响旅游者对整个旅游过程的评价,甚至会影响到旅游者对旅游目的地形象的客观评价。河南省作为一个旅游资源大省,旅游商品种类丰富,但是河南省的旅游购物消费在整个旅游消费中一直处于较低的水平,远远不及景区的门票、旅游餐饮和住宿的收入,并且有相当一部分旅游者对旅游购物整体感觉不满。造成这类现象的原因有很多,其中旅游购物环境差是造成旅游者不满的一个主要原因。 在2013年10月1日《旅游法》颁布并实施后,在法律条文中明确规定了旅行社不得通过向游客安排购物或者增加自费项目来获取一些不正当的利益,同时在旅游行程中不能指定具体购物场所。随着《旅游法》的实施,给中国旅游业的发展带来了新的希望和保障,同时在各地也引起了很大的反响,旅行社产品全面调整,购物线路和购物点都从旅游线路中大幅度的删除,对于河南省这类本身旅游购物收入比重占整个旅游收入比重都较小的区域来说,旅游购物的发展更是雪上加霜。在当下的旅游大环境下,我们必须充分认识到,如何依据《旅游法》的规定,规范旅游行程,同时在不影响旅游者旅游的过程下提高旅游者的购物消费,增加旅游收入。 通过相关研究发现,关于旅游购物环境的研究很少,,并且一般都是对旅游购物的构成进行分析。在已往研究的基础上,本文提出了以旅游业发展中旅游购物环境的依法建设和管理作为研究对象,通过调研分析了河南省旅游购物环境存在的问题,并就此提出解决问题的对策。文章首先针对旅游业法律体系建设在对国内外旅游业的影响进行研究分析,利用文献研究和调研相结合的方法,借鉴国内外的先进经验,结合河南省独特区域的旅游购物环境进行分析。其次,研究《旅游法》在旅游业中的作用和发展,本文从法律角度对旅游业的主要影响进行解释《旅游法》在旅游业中的作用,针对河南进行实证分析,引用法律法规,以促进河南省旅游购物环境在法律的监管下得到完善发展。最后总结并针对研究的问题提出相应的应对举措,在《旅游法》法律的监管下,提出能够对于河南省甚至全国具有一定影响力的适应旅游者购物需求的良好旅游购物环境,增加地方的旅游购物消费和旅游收入。以期通过本文的研究,能为地方建立健全旅游购物相关的法律法规提供参考依据,为构建完美的旅游购物环境的建设,稳定和可持续发展提供重要保证。
[Abstract]:Tourism as a new industry, although starting late, but with the rapid development and operation of the national economy, tourism with its unique vitality and development potential rapid development, the economic benefits are increasingly enhanced. Tourism shopping as an experiential link of tourism, the degree of pleasure of its shopping process will affect the tourists' evaluation of the whole tourism process, and even affect the tourists' objective evaluation of the image of the tourist destination. Henan Province, as a province with large tourism resources, has a rich variety of tourist commodities. However, the consumption of tourism shopping in Henan Province has been at a relatively low level in the whole tourism consumption, which is far less than the income of tickets, tourist catering and accommodation in scenic spots. And there are quite a number of tourists to travel shopping overall feeling dissatisfied. There are many reasons for this phenomenon, among which poor tourist shopping environment is one of the main reasons for tourist dissatisfaction. Following the promulgation and implementation of the Tourism Law on October 1, 2013, the law explicitly stipulates that travel agencies are not allowed to obtain undue benefits by arranging shopping or increasing self-financing items from tourists. At the same time in the travel itinerary cannot specify the specific shopping place. With the implementation of the "Tourism Law", it has brought new hopes and guarantees to the development of China's tourism industry. At the same time, it has also caused great repercussions in various places. The products of travel agencies have been comprehensively adjusted. Shopping routes and shopping points are removed from the tourist routes by a large margin. The development of tourism shopping in Henan Province, where the proportion of tourism shopping income is small, is even worse. In the current tourism environment, we must fully realize how to regulate the travel schedule according to the regulations of "Tourism Law", and at the same time, increase the tourists' shopping consumption and tourism income in the process of not affecting the tourists' tourism. It is found that there are few researches on tourism shopping environment, and the composition of tourism shopping is generally analyzed. On the basis of the previous research, this paper takes the legal construction and management of tourist shopping environment in the development of tourism industry as the research object, and analyzes the problems existing in the tourist shopping environment of Henan Province through investigation and analysis. And put forward the solution to the problem. Firstly, the paper analyzes the impact of the legal system construction of tourism on the tourism industry at home and abroad, and uses the method of combining literature research and research to learn from the advanced experience at home and abroad. Combined with the unique area of Henan Province tourism shopping environment analysis. Secondly, the paper studies the role and development of Tourism Law in tourism industry. This paper explains the main impact of Tourism Law on tourism industry from the angle of law, analyzes the role of Tourism Law in tourism industry from the perspective of laws and regulations, and makes an empirical analysis on Henan Province, citing laws and regulations. In order to promote Henan Province tourism shopping environment under the supervision of the law to improve the development. Finally, the author summarizes and puts forward corresponding measures to deal with the problems studied. Under the supervision of the "Tourism Law", it puts forward a good tourist shopping environment which can have certain influence on Henan Province and even the whole country to meet the needs of tourists' shopping. Increase local tourism shopping consumption and tourism income. Through the study of this paper, it can provide reference for the establishment and improvement of local laws and regulations related to tourism shopping, and provide an important guarantee for the construction of a perfect tourist shopping environment, stability and sustainable development.
