劳务输出地政府强化农民工就业权益保障的对策研究

【摘要】:农民工是由于我国户籍制度的建立,且伴随着我国城镇化及现代化的快速推进而形成的一个特殊的社会群体,他们身份是农民,但工作和生活重心逐步向城市和非农产业转变,已经成为加快我国现代化进程的中坚力量。而进入21世纪后,受我国城乡二元结构、相关体制还未健全完善,以及农民工群体自身特点等各方面因素影响,农民工外出务工时其就业权益很难得到有效保障,同时,在农民工的就业权益受到侵害以后,他们缺少正常的渠道来维护自己的合法权益。如何有效保障农民工就业权益已成为社会、政府和学术界讨论的热点问题。近年来,受到金融危机的影响,农民工“返乡潮”、“民工荒”现象交替出现,农民工流动数量急剧增加,这就给劳务输出地和输入地政府都带来了新的管理难题,在强化农民工就业权益保障上提出了新的要求。就业是民生之本,对于外出务工的农民工来说,就业权益是其经济、政治和社会等各项权益的基础,农民工的就业权益得不到有效保障,将会影响到大量的农村转移劳动力日常的生活、生产,进而影响整个社会的稳定和发展,成为制约我国城市化进程和城乡统筹发展的“瓶颈”。 政府的权力是人民赋予的,,本文认为,政府应该不断加强对公民和社会的责任感,尤其是针对农民工这一特殊的庞大的群体,更要积极作为,有效保障他们的就业权益。而劳务输出地政府作为农民工户籍所在地和归属地的责任主体,更应当在保障农民工权益上发挥主体作用。本文站在劳务输出地政府的角度,通过对目前我国中央到地方现行的相关政策,四川省等典型劳务输出地对农民工就业的基本现状和就业权益保障现状进行分析,讨论了目前劳务输出地农民工就业权益保障所存在的问题和主要原因,从而得出了劳务输出地政府保障农民工就业权益的对策,即构建农民工就业权益保障机制:一是建立与输出地政府之间的合作机制;二是要建立引导农民工有序就业的服务机制,从而进一步强化外出务工的农民工就业权益保障。
[Abstract]:Migrant workers are a special social group formed by the establishment of household registration system and the rapid development of urbanization and modernization in our country. They are farmers, but the focus of work and life is gradually changing to cities and non-agricultural industries. Since 21th century, it has been affected by the dual structure of China's urban and rural areas, the imperfect system and the characteristics of migrant workers. When migrant workers go out to work, their employment rights and interests are difficult to be effectively protected. At the same time, after the employment rights and interests of migrant workers are infringed, They lack normal channels to protect their legitimate rights and interests. How to effectively protect the employment rights and interests of migrant workers has become a hot issue in society, government and academia. In recent years, they have been affected by the financial crisis. The phenomenon of migrant workers'"returning to their hometowns" and "shortage of migrant workers" alternately appears, and the number of migrant workers' mobility has increased sharply, which has brought new management problems to the governments of both the labor export and the importing countries. New requirements have been put forward to strengthen the protection of migrant workers' employment rights and interests. Employment is the foundation of people's livelihood. For migrant workers, employment rights and interests are the basis of their economic, political and social rights and interests. If the employment rights and interests of migrant workers are not effectively protected, it will affect the daily life and production of a large number of rural migrant workers, thereby affecting the stability and development of the whole society. It has become the bottleneck that restricts the process of urbanization and the overall development of urban and rural areas. The power of the government is conferred by the people. This paper holds that the government should constantly strengthen its sense of responsibility to the citizens and the society, especially for this special large group of migrant workers. The government of the export place of labor service, as the responsible subject of the place where the migrant workers are registered and belonging, should play a main role in protecting the rights and interests of the migrant workers. Through the analysis of the current relevant policies from the central to local governments and the typical labor export places such as Sichuan Province, this paper analyzes the basic status quo of the employment of migrant workers and the present situation of protecting their employment rights and interests. This paper discusses the existing problems and main reasons of the protection of the employment rights and interests of migrant workers in the labor export areas at present, and concludes the countermeasures for the governments of the labor export places to protect the employment rights and interests of the migrant workers. The first is to establish a cooperative mechanism between the government and the exporting government; the other is to establish a service mechanism to guide the orderly employment of migrant workers, so as to further strengthen the protection of migrant workers' employment rights and interests.
