网络经济违法的监管模式构建

【摘要】：随着经济全球化发展和互联网应用普及，以互联网络为载体的经济交易活动大量涌现，这一新兴经济形式—网络经济，因其巨大的成长空间和市场潜力，引起社会各界的重点关注。然而，网络交易具有的环境开放、主体虚拟化、行为隐蔽和方式多变等特点，因而也滋生了数量庞大形式繁多的网络经济违法行为，这日渐成为严重的社会问题。2010年互联网服务投诉量上升了68.7%，2011年我国超过8%网民遇到过网上消费欺诈。我国传统的监管规制在解决3Q大战、淘宝新规等网络群体事件时显得捉襟见肘。那么，是什么因素影响和决定着网络经济违法的有效监管呢？如何创新网络经济监管模式，保障公平竞争的社会主义网络经济市场秩序？对这些问题做出回答，需要对网络经济违法监管的影响因素及其作用机理进行深入研究。为此，本文做了如下研究： ①分析影响网络经济违法监管的要素，对影响要素的作用机理进行深入探索。 本文从管理学、信息经济学、行政法学等交叉学科角度，结合我国网络经济违法监管现状和近10年的CNKI网相关研究文献，系统深入地分析影响网络经济违法监管的要素，对影响要素的作用机理进行定量研究和数量刻画。提出网络经济违法监管的主要影响要素：政府监管机构（监管主体）、网络经营群体（监管客体）、网络交易平台和政府监管网。 ②分析网络交易中监管主客体博弈特征，对主客体的成本效益进行数量刻画。 本文结合我国当前网络经济运行的现实情况，引入有限理性理论，采用进化博弈方法模拟监管主体、客体之间的利益均衡，找出网络经济违法监管中影响双方相互作用的主要因素。研究结果表明，国家可给予相关监管机构专项补贴；增强违法经营行为对社会、政府负效应的影响程度；应增大网络经营者违法经营的查处罚金；大力推行国家项目资金向企业的倾斜力度。 ③分析网络经济违法的监管主体工作方式，构建了政府的“T周期”监管模式。 本文针对我国相关监管机构对网络交易违法行为的具体监管流程，设计了一种“T周期”的循环监管机制，研究采用马尔可夫链，计算出n阶段博弈之后的策略组合概率分布，实现预测网络交易监管策略组合的走向，并通过仿真论证了“T周期”监管机制的科学性。监管机构在采用“T期”监管期的监管方式后，能够实现加强对违法主体的信息传递，提高{监管，，不违法}策略组合出现的概率。 ④系统分析网络空间的经济活动规律,构建了网络经济违法的技术监管模型。 本文基于网络平台特征，以网络经济违法案件为主要研究对象，建立网络经济违法监管各要素相互作用的系统动力学模型，仿真结果显示监管技术研发投入能够有效提升监管效率。根据研究结论构建了“以网管网”的网络经济违法的技术监管模型，模型由电子商务经营主体模块、电子商务监管服务网模块、网络广告智能监测平台、电子商务搜索监测平台、电子证据采集平台等五大模块构成。该网络经济违法技术监管模型在***市工商局电子商务监管和***市级电子数据取证实验室中得到应用。
