网络虚假宣传行为法律问题研究

【摘要】:数字应用技术的迅速崛起促进了现代社会网络交易的应用与普及,经营者不断将生产力与注意力集中于网络资源的拓展与开发,期望借助网络的交互性拓宽产品的宣传渠道,最大程度的加强产品的宣传成效,网络宣传俨然成为一种商业竞争的热门营销手段。与此同时,在有限的网络市场资源下衍生了一批不法经营者为抢占商机,恶意通过不正当虚假宣传手段倾轧同行业经营者。而将虚假宣传放置于网络传播的大环境下,其开放性与纵深性,使得虚假宣传的弊端与影响无限放大甚至难以控制,这种影响不仅会打乱了网络的良性市场竞争秩序更会引发合法经营者及消费者不可预估的损失。论文着眼于当前我国法律规范实际,从法治的视角剖析了网络虚假宣传行为,对于统一协调法律法规的解释和适用、完善网络监管制度设计具有实践意义。论文立足于三网融合的大背景下,以网络虚假宣传行为的法理分析为切入点,尝试性对该行为性质进行法律界定,对比域外网络领域反不正当竞争先进立法模式及监管体制,进而针对我国现行法律制度的不足,探索我国规制网络虚假宣传行为的法律路径。在充分运用法律分析法、类型分析法以及比较研究法的基础上,针对网络虚假宣传行为的典型类型、现行法律选择适用情况等进行系统的分析与归纳,整理出规制网络虚假宣传行为切实有效的法律规范体系,以保障我国网络市场经济的有序发展,为肃清网络电商环境、规制网络不正当竞争行为、增强消费者网络法制观念提供可操作性意见及建议。
[Abstract]:The rapid rise of digital application technology has promoted the application and popularization of network transactions in modern society, and the operators have continuously focused their productivity and attention on the expansion and development of network resources. Hope to use the interactivity of the network to broaden the channels of product publicity, to maximize the effectiveness of product publicity, network publicity has become a commercial competition of the popular marketing means at the same time. In the limited network market resources derived a number of illegal operators in order to seize business opportunities, maliciously through improper and false means of propaganda against the same industry operators. Its openness and depth make the malpractice and influence of false propaganda infinitely magnify and even difficult to control. This kind of influence will not only disrupt the healthy market competition order of the network, but also lead to the unpredictable loss of legal operators and consumers. From the perspective of the rule of law, this paper analyzes the network false propaganda behavior, which is of practical significance for the unified and coordinated interpretation and application of laws and regulations, and the improvement of the design of the network supervision system. The thesis is based on the background of the integration of three networks. Taking the legal theory analysis of the network false propaganda as the starting point, this paper tries to define the nature of the act by law, and compares the advanced legislative model and the supervision system against unfair competition in the overseas network field. In view of the shortcomings of our current legal system, we explore the legal path to regulate the false propaganda on the network. On the basis of making full use of the law analysis method, the type analysis method and the comparative research method. According to the typical types of network false propaganda, the current situation of law selection and application are systematically analyzed and summarized, and the effective legal system to regulate the network false propaganda is put forward. In order to ensure the orderly development of our country's network market economy, this paper provides operational opinions and suggestions for eliminating the network e-commerce environment, regulating the unfair competition behavior of the network, and strengthening the concept of consumer network legal system.
