二维码商业应用下的商标权保护研究

【摘要】:随着移动信息技术的进步以及智能手机、平板电脑等无线设备的普及,企业开始日益重视移动商务市场。与此同时,企业的商业活动也日益趋向于使用更加吸引消费者的互动类型。在各种商业应用之中,二维码商业应用是近年来企业经常使用的商业营销方式,由于其与以往的传统营销有所不同,商标的使用呈现出许多新的方式,一些潜在的商标侵权形式也伴随着二维码商业应用的普及而出现,商标的初始兴趣混淆问题日益凸显,将不可避免地影响二维码商业应用下的商标权保护。因此,在我国信息化和市场化快速发展的当下,有必要对初始兴趣混淆理论进行深入探析,加强二维码商业应用下的商标权保护,以保障新型商业应用的健康发展。第一章简要介绍了二维码商业应用,总结了商标在二维码商业应用中常见的使用方式以及潜在的商标侵权形式,强调其构成商标侵权核心的混淆主要是初始兴趣混淆。第二章着重探讨了二维码商业应用下商标侵权认定的变化,阐述了商标侵权认定中初始兴趣混淆理论适用的相关内容。第三章概括总结了二维码商业应用下我国商标权保护的现状与不足,同时基于初始兴趣混淆理论对完善我国商标权保护提出建议。
[Abstract]:With the development of mobile information technology and the popularity of wireless devices such as smart phones and tablets, enterprises begin to pay more and more attention to the mobile business market. At the same time, business activities also increasingly tend to use more attractive consumer interaction types. Among all kinds of commercial applications, the two-dimensional code commercial application is a commercial marketing method which is often used by enterprises in recent years. Because of its difference from the traditional marketing in the past, the use of trademarks presents many new ways. Some potential trademark infringement forms also appear with the popularity of the commercial application of QR code. The confusion of trademark's initial interest is becoming more and more prominent, which will inevitably affect the protection of trademark right under the commercial application of QR code. Therefore, with the rapid development of informatization and marketization in China, it is necessary to probe into the theory of initial confusion of interest and strengthen the protection of trademark rights under the commercial application of two-dimensional code, so as to ensure the healthy development of new commercial applications. The first chapter briefly introduces the commercial application of QR code, summarizes the common use modes and potential forms of trademark infringement in the commercial application of QR code, and emphasizes that the confusion that constitutes the core of trademark infringement is mainly the confusion of initial interest. The second chapter focuses on the change of trademark infringement identification under the commercial application of two-dimensional code, and expounds the relevant content of the application of initial interest confusion theory in trademark infringement identification. The third chapter summarizes the current situation and deficiency of trademark right protection in China under the commercial application of two-dimensional code, and puts forward some suggestions to perfect the protection of trademark right in China based on the theory of initial interest confusion.
