合约制治理研究论纲

【摘要】：作为国家治理(或政府治理)的一种新方式或新机制,合约制推动了国家治理方式从单向依赖走向双向互动、从行政指令走向契约合作,适应了我国激发市场活力、调动社会创造力的改革发展需要。可以围绕合约制如何在交易成本、有限理性、技术水平和社会规范等多重约束条件的影响下达成委托方和代理方的激励兼容等方面进行研究,形成一个有别于哲学、政治学、法学、经济学视角的公共部门管理的合约制理论,并对合约制的有效性进行检验,梳理合约制在当代国家治理中的实践方式和应用路径,为公共部门推广应用合约制提供有益的理论指导和对策建议。
[Abstract]:As a new way or mechanism of national governance (or government governance), contract system promotes the mode of national governance from one-way dependence to two-way interaction, from administrative order to contractual cooperation, and adapts to stimulate market vitality in China. The reform and development need to mobilize social creativity. We can study how the contract system can achieve the incentive compatibility between the client and the agent under the influence of multiple constraints such as transaction cost, limited rationality, technical level and social norms, etc. Forming a contract system theory of public sector management from the perspective of philosophy, politics, law and economics, and testing the effectiveness of contract system, combing the practice and application path of contract system in contemporary national governance. It provides useful theoretical guidance and countermeasures for public sector promotion and application of contract system.
