中国官员财产申报制度建设性研究

【摘要】：官员财产申报制度要求国家官员按照规定申报其财产的来源、现状、变动等情况,并由相关机构依据法定程序予以公示,接受社会的监督,是能够有效地规范官员行为的公示制度。从官员财产申报制度产生之日起,对反腐倡廉、树立政府和官员的良好形象起到积极作用。中国的官员财产申报渊源已久,但是无论是从完善立法,规范申报程序,还是加大监督,加强法律制裁上都没有得到很好的发展。官员财产申报制度是战胜腐败问题的一个利器,有效地的发挥这个利器的作用,对我国廉洁政府的建设有重要的促进作用。官员作为一个社会人也是经济人,也存在着理性思考和个人利益最大化的追求,这样在行使公共权力的过程中就会存在着大量的利益冲突。所以我们需要对政府和官员进行必要的监督和制约,否则利益冲突将会造成公共权力的滥用。官员接受人民群众赋予的权力,以维护和促进社会公共利益为己任,就应该让公众了解官员在行使公共权力时是否在以权谋私,体现在经济方面就是官员的花费是否与他的实际正常收入水平相符。官员财产申报制度就是这把标尺,能让公众对官员的花费和收入做出正确的对比,是对官员进行全力监督和制约的一项重要制度。
[Abstract]:The official property declaration system requires state officials to declare the source, status quo, changes of their property in accordance with the relevant regulations, and the relevant institutions shall publicize it in accordance with the legal procedures and accept the supervision of the society. It is a public announcement system that can effectively standardize the behavior of officials. From the date of the emergence of the official property declaration system, it has played a positive role in combating corruption and promoting honesty and establishing a good image of the government and officials. China's official property declaration has a long history. However, no matter in terms of improving legislation, standardizing reporting procedures, increasing supervision and strengthening legal sanctions, no good development has been made. The property declaration system of officials is a powerful weapon in overcoming the problem of corruption. To play the role of this sharp weapon effectively plays an important role in promoting the construction of a clean government in our country. As a social person, officials are also economic people, and they also have the pursuit of rational thinking and maximization of personal interests. In this way, there will be a large number of conflicts of interest in the exercise of public power. Therefore, we need to exercise the necessary supervision and restriction on the government and officials. Otherwise, conflicts of interest will result in the abuse of public power. When officials accept the power conferred by the people and take safeguarding and promoting the public interest as their own duty, they should let the public know whether officials are using their power for personal gain when exercising public power. The economic aspect is whether the official's expenditure is in line with his actual normal income level. The official property declaration system is such a yardstick that allows the public to make a correct comparison between the official's expenditure and his income. It is an important system for the full supervision and restriction of officials.
