工程建设领域中介机构腐败行为分析及其治理

【摘要】：工程建设领域历来是腐败的"重灾区"。其中,许多腐败行为是由中介机构参与实施的,这严重损害了市场竞争秩序,也易引发工程质量、安全事故。工程项目建设专业性强,涉及到的中介机构众多,而不同中介机构的腐败路径各不相同,治理对策也应有所差异,有必要对其进行分类研究。在当前国家全面清理、规范中介服务的社会大背景下,梳理了工程建设领域的中介服务,厘清了工程项目建设中的建设环节、中介业务、中介机构之间的映射关系,并从市场化程度和行政化程度这两个维度对工程中介机构进行了分类;着重基于权力来源不同的视角归纳总结了准行政类和其它类工程中介机构常见的腐败行为,剖析了这两类工程中介机构腐败行为的共同特征和各自特征;针对这些特征,提出了工程中介机构腐败行为的治理对策,以供政府相关部门决策参考。
[Abstract]:Engineering construction field has always been a corrupt "disaster area."Among them, many corrupt behaviors are carried out by intermediary organizations, which seriously damages the order of market competition, and easily leads to engineering quality and safety accidents.The construction of engineering project is professional and involves many intermediary organizations, but the corrupt paths of different intermediary organizations are different, and the countermeasures of governance should be different, so it is necessary to classify them.In the current social background of overall national clean-up and standardization of intermediary services, this paper combs the intermediary services in the field of engineering construction, clarifies the mapping relations among the construction links, intermediary business, and intermediary agencies in the construction of engineering projects.And from the marketization and administrative degree of the two dimensions of the classification of engineering intermediary organizations, focusing on different sources of power based on the perspective of summing up the quasi-administrative and other types of engineering intermediary agencies common corruption,This paper analyzes the common characteristics and their respective characteristics of the corrupt behavior of the two kinds of engineering intermediary organizations, and puts forward the countermeasures for the governance of the corrupt behavior of the engineering intermediary organizations in order to provide references for the relevant government departments to make decisions.
