【摘要】：食品安全监管的行政问责是我国行政问责体系的一个重要组成部分。食品安全不仅联系着每位公民的切身利益,也关乎着整个国家的政治治理与社会稳定大局。据“2016中国平安小康指数”调查报告显示,食品安全已经连续5年稳居最让人担忧的十大安全问题榜首。从中我们不难发现,人们对食品安全的关注之高,也从侧面可以看出我国的食品安全监管体系还存在许多漏洞,其中像监管部门监管失位、错位、问责乏力等问题的存在具有不可推卸的责任,亟待进一步完善。因此,打造健康、透明、高效的食品安全监管行政问责体系对于建设放心绿色食品环境,保障广大人民食品安全起着关键性的作用。同时,进一步强化我国食品安全监管的行政问责也有利于营造良好的社会问责文化,有利于对政府官员行政行为进行有效监督,有利于提升政府社会综合治理水平,有利于维护人民的权益,促进社会的和谐稳定发展。本文从食品安全的基本理论着手,对相关概念与理论进行简单阐述,以食品安全监管的行政问责为研究对象,采用文献分析法、案例分析法以及比较研究法,从我国食品安全监管的行政问责现状出发,分析食品安全事件行政问责相关案例,重点探析我国食品安全监管的行政问责方面存在的不足,如食品安全监管中行政问责主客体责任不明、问责程序混乱,法律建设缺失等,通过借鉴美国、加拿大、英国、澳大利亚食品安全监管与行政问责的有效经验,提出具体完善对策。正文分为五大部分,分别为基本理论阐述,我国食品安全监管的行政问责现状研究,国际上食品安全监管的行政问责经验借鉴,针对我国食品安全监管的行政问责存在的问题提出相应的对策建议,从健全监督体系,完善相关制度,营造社会问责文化,激发全社会的力量共同参与食品安全监管,希望通过这些方面的举措可以保障人民舌尖上的安全。
[Abstract]:The administrative accountability of food safety supervision is an important part of our country's administrative accountability system. Food security relates not only to the vital interests of every citizen, but also to the political governance and social stability of the whole country. Food safety has topped the list of top 10 safety concerns for five consecutive years, according to the 2016 China Ping an Well-off Index survey. It is not difficult for us to find that there are still many loopholes in the food safety regulatory system of our country, such as the misplacement and dislocation of the supervision and control of the regulatory authorities, as well as the high level of concern for food safety. Lack of accountability and other problems have unshirkable responsibilities, and need to be further improved. Therefore, creating a healthy, transparent and efficient administrative accountability system for food safety supervision plays a key role in building a safe green food environment and ensuring the food safety of the broad masses of the people. At the same time, further strengthening the administrative accountability of food safety supervision in China is also conducive to creating a good culture of social accountability, to effectively supervising the administrative behavior of government officials, and to promoting the level of comprehensive governance of the government. It is conducive to safeguarding the rights and interests of the people and promoting the harmonious and stable development of society. Starting from the basic theory of food safety, this paper briefly expounds the related concepts and theories, takes the administrative accountability of food safety supervision as the research object, adopts the literature analysis method, the case analysis method and the comparative research method. Starting from the current situation of administrative accountability in food safety supervision in China, this paper analyzes the relevant cases of administrative accountability for food safety incidents, and probes into the deficiencies of administrative accountability in food safety supervision in China. For example, the subject and object responsibility of administrative accountability in food safety supervision is not clear, the procedure of accountability is confused, and the law construction is missing. By learning from the effective experience of food safety supervision and administrative accountability in the United States, Canada, Britain and Australia, Put forward the concrete consummation countermeasure. The text is divided into five parts, respectively for the basic theoretical elaboration, China's food safety supervision of the status quo of administrative accountability, international food safety supervision of administrative accountability experience, In view of the problems existing in the administrative accountability of food safety supervision in our country, this paper puts forward corresponding countermeasures and suggestions, including perfecting the supervision system, perfecting the relevant system, creating a social accountability culture, and motivating the whole society to participate in the food safety supervision together. It is hoped that these measures will ensure the safety of the people on the tip of the tongue.
