论工程风险的责任——基于公共安全的视角

【摘要】:按照传统的四极张力关系即"谁、为什么、在谁面前、依哪些标准"难以确定工程风险的责任。需要改变过于窄化的责任概念,丰富工程风险责任的涵义,拓展工程风险责任的边界。工程风险的责任是多维度的复合的共同责任。建立一个共同责任的理论模型,以积极责任和消极责任为分析框架,探讨工程风险责任的分配。
[Abstract]:According to the traditional quadrupole tension relation, namely "who, why, in front of who, which standard" is difficult to determine the responsibility of engineering risk. It is necessary to change the concept of overly narrowed responsibility, enrich the meaning of engineering risk responsibility and expand the boundary of engineering risk responsibility. The theoretical model of responsibility is based on the analysis framework of positive responsibility and negative liability, and explores the allocation of engineering risk responsibility.
