城镇化进程中村民自治面临的问题研究

【摘要】：伴随着城镇化进程,人口流动、土地变化对村民自治产生了一些新的问题,如：村委会如何克服“空心村”管理不足?城中村中的外来人口如何参与自治?村民自治组织如何捋顺与政府和村民的关系?村民自治组织将有那些变化?针对这些新问题,从法律层面上找出现行村民自治制度的不足,提出解决方案,是本文的目的。具体而言,在法律制度方面重点研究以下几点：人口流动因素对村民自治的影响、村委会向居委会转型讨论、城镇化中村委会与农村新型社区的关系、城镇化进程中农民问题增多的法律原因。本文认为通过以下途径：完善空心村的自治制度；完善外来人口参与村民自治的法律制度；完善村民自治组织和集体经济组织的制度；加强村民自治组织的职能；建立规范的村改“居”法律制度；明确社区的性质和法律地位；送法下乡,为农民普法等,使我国的村民自治制度得到完善。
[Abstract]:With the urbanization process, population mobility, land changes to the villagers autonomy has produced some new problems, such as: how the village committee to overcome the "hollow village" management deficiencies? How does the alien population in the village participate in autonomy? How to smooth the relationship between the villager autonomy organization and the government and the villagers? What changes will there be in the villager's autonomous organization? In view of these new problems, it is the purpose of this paper to find out the deficiency of the current villager autonomy system from the legal level and to put forward the solution. In particular, the following aspects of the legal system are focused on: the impact of population mobility on villagers' autonomy, the transformation of village committees to neighborhood committees, and the relationship between village committees and new rural communities in urbanization. The legal reasons for the increase of farmers' problems in the process of urbanization. The author thinks that the following ways should be adopted: perfecting the self-governing system of hollow village, perfecting the legal system of the alien population participating in the villagers' autonomy, perfecting the system of villagers' autonomous organization and collective economic organization, strengthening the functions of villagers' self-governing organization; The establishment of a standardized legal system for village reform, the clarification of the nature and legal status of the community, the sending of laws to the countryside, the popularization of the law for the peasants, and so on, have improved the system of villager autonomy in our country.
