济南市行政规范性文件行政审查问题研究

【摘要】：行政规范性文件的行政审查工作日益受到社会各界的重视,但当前很多理论研究未能准确反映实践中的问题。行政规范性文件行政审查具有很强的地域色彩,属地研究对于推动一个地区的行政规范性文件行政审查工作具有十分重要的意义。本文选取济南市行政规范性文件的行政审查工作进行研究。通过对比国务院与全国主要省、市行政规范性文件行政审查情况的差异,对全国行政规范性文件行政审查模式进行分类,作出了根据行政级别选取行政规范性文件行政审查模式的动因分析。指出了济南市行政规范性文件行政审查工作的特点,评价了适应这些特点的行政审查模式,提出了济南市行政规范性文件行政审查工作实践中存在的重事前审查而轻事后监督、行政规范性文件行政审查主体面临的现实困境、具体工作机制尚不完善等问题,分别从行政规范性文件审查过程的各个环节指出实践中存在的机制缺陷,并分析原因,进而从制度建设的角度提出了建议。在行政规范性文件行政审查主体方面,提出改革政府法制机构工作方式,增加行政规范性文件行政审查主体的监督权限,强化审查深度,同时通过对政府部门法制机构行政审查的量化评分促进政府法制机构均衡化建设。在制度建设方面,提出建立清理长效机制,并着重分析通过清理确定修改的行政规范性文件处理方式。提出建立后评估制度,详细论述了评估参与主体应当具备的特点。在制度运行机制方面,提出完善行政规范性文件行政审查信息管理手段,综合运用行政管理大数据,实行行政规范性文件行政审查意见有效期制度。在审查标准方面,文章论证了如何通过制定合法的文件来促进改革创新,实现互联网+行政规范性文件行政审查的目标。本文着眼于实践,提出了具体而现实的问题,通过理论工具进行分析,最终回归实践,指出了合理化建议。我国行政规范性文件规范化发展的历史不长,但这项工作对建设社会主义法治国家而言意义重大。于济南而言,进一步完善行政规范性文件的行政管理工作,也是建设法治泉城的重要举措。
[Abstract]:The administrative review of administrative normative documents has been paid more and more attention by all walks of life, but many theoretical studies have failed to accurately reflect the problems in practice. The administrative review of administrative normative documents has a strong regional color, and the study of the territory is of great significance to promote the administrative review of administrative normative documents in a region. This article selects Jinan administrative normative document administrative examination work carries on the research. By comparing the differences between the State Council and the major provinces and municipalities in the country, the paper classifies the administrative review modes of the national administrative normative documents. According to the administrative level of the choice of administrative normative documents administrative review mode of motivation analysis. This paper points out the characteristics of administrative review of administrative normative documents in Jinan, evaluates the administrative review mode adapted to these characteristics, and puts forward that the practice of administrative review of administrative normative documents in Jinan pays more attention to the prior examination rather than the supervision after the event. This paper points out the defects of the mechanism in practice from the aspects of the administrative normative documents review process, such as the realistic predicament faced by the subject of administrative normative documents' administrative review and the imperfect concrete working mechanism, and analyzes the reasons. And then put forward suggestions from the point of view of system construction. With regard to the subject of administrative examination of administrative normative documents, it is proposed to reform the working methods of government legal institutions, to increase the supervisory authority of the subject of administrative examination of administrative normative documents, and to strengthen the depth of examination. At the same time, it promotes the equalization of the government legal institutions through the quantitative evaluation of the administrative review of the legal institutions of government departments. In the aspect of system construction, this paper puts forward the establishment of long-effect mechanism of cleaning up, and emphatically analyzes the ways of dealing with administrative normative documents which are fixed and modified by cleaning up. A post-evaluation system is proposed and the characteristics of the participants are discussed in detail. In the aspect of system operation mechanism, this paper puts forward to perfect the information management means of administrative review of administrative normative documents, comprehensively apply administrative management big data, and carry out the validity period system of administrative review opinions of administrative normative documents. In the aspect of examining standard, the article demonstrates how to make legal documents to promote reform and innovation, and to realize the goal of administrative review of Internet administrative normative documents. Focusing on practice, this paper puts forward concrete and practical problems, analyzes them through theoretical tools, and finally returns to practice, and points out some reasonable suggestions. The standardization of administrative normative documents in China has a short history, but this work is of great significance to the construction of a socialist country ruled by law. As far as Jinan is concerned, it is also an important measure to improve the administration of administrative normative documents.
