我国政府加强图书盗版盗印治理对策研究

【摘要】：图书盗版盗印现象一直以来是影响我国出版业健康发展的一颗毒瘤。随着时代的发展,它并没有被淘汰,反而愈演愈烈,不断“创新”,盗版不是传统意义上的盗版,盗印也不简单的复印,它们在相互融合,打着擦边球存在于社会中,不但在市场竞争中侵害了合法经营者的权益,破坏了正常的市场秩序,同时也损害了版权人的应得权益,还阻碍了我国社会主义文化建设。虽然我国政府对图书盗版盗印持坚决打击的态度,在立法、司法上针对该行为做出了相应的规定,以防止该现象的发生,但是,我国当前版权意识并没有深入人心,同时图书盗版盗印存在着高额的利润,驱使无良商贩做出违反法律的盗版盗印行为,以及近年来社会上存在的“山寨”风气,图书盗版盗印行为越发猖厥。如何整顿图书盗版盗印现象,是政府加强社会主义文化建设,提高全民族文明素质,全面建设小康社会中的重要课题。本文以我国政府对图书盗版盗印问题治理为研究对象,以公共行政理论、公共治理理论、公共选择理论、新公共管理理论等相关理论为理论基础,以对国内外政府治理图书盗版盗印的研究情况加以总结为参考,通过问卷调查的方式对当前我国政府治理图书盗版盗印的现状进行调查分析。总结我国政府在治理图书盗版盗印取得的成绩同时,找出存在的问题与不足,针对问题寻找原因,借鉴美国、新加坡等对图书等知识产权保护较为突出的国家的经验,探索解决问题的方法对策。结合当前我国的国情,同时借鉴美国、新加坡等对图书等知识产权保护较为突出的国家的经验,本文提出了加强我国政府治理图书盗版盗印的对策建议:首先,发挥政府主导作用,加强政府部门之间的联系,建立政府、公众共同参与机制,充分调动出版社等权利人的自我维权意识;其次,完善相关法律法规体系,完善出版市场准入制度,运用价格法加强对图书业的价格调控;再次,加大执法力度,规范执法工作队伍;最后,重视日常管理,持久深入地开展反图书盗版盗印工作,同时发展经济,提高公民购买正版图书能力,加强舆论宣传,提高社会打击图书盗版盗印的认同感。一系列的对策初探,力求对我国政府治理图书盗版盗印问题上提出建设性意见,从而对我国现有的打击图书盗版盗印措施和手段予以完善,希望能对制定更加有效地打击图书盗版盗印和保护知识产权的政策献言献策。
[Abstract]:The phenomenon of piracy and theft of books has always been a malignant tumor that affects the healthy development of China's publishing industry. With the development of the times, it has not been eliminated. Instead, it is becoming more and more vigorous and constantly "innovating". Piracy is not a traditional piracy, and the theft is not simply copied. They are merging with each other in society, not only in society, but also in society. In the market competition, the rights and interests of the legal operators are violated, the normal market order is destroyed, and the rights and interests of the copyright owners are damaged, and the construction of our socialist culture is hindered. Although our government has a resolute attack on the piracy and theft of books in China, it has made the corresponding provisions in the legislation and the judicature to prevent it. In order to stop this phenomenon, the current copyright consciousness of our country has not been deeply rooted in the hearts of the people. At the same time, there is a high profit in the piracy and theft of books, which drives the unscrupulous traders to make illegal piracy and piracy, as well as the "Shanzhai" behavior in the society in recent years, and the theft of books is more and more rampant. The phenomenon of printing is an important topic for the government to strengthen the construction of socialist culture, improve the quality of the whole nation and build a well-off society in an all-round way. This article takes the government of our government to study the problem of piracy and theft of books as the research object, with the theory of public administration, public governance theory, public choice theory and new public management theory as the theoretical basis. On the basis of summarizing the domestic and foreign government's research on piracy and theft of books, this paper makes a survey and Analysis on the current situation of government administration of piracy and theft of books by the government. To find out the reasons, draw lessons from the experience of the states which are more prominent in the protection of intellectual property rights in the United States and Singapore, and explore the methods and Countermeasures to solve the problems. In the light of the current national conditions of our country and the experience of the countries with prominent protection of intellectual property rights in books such as the United States and Singapore, this article puts forward to strengthen our government to govern books theft. The countermeasures are as follows: first, give full play to the government's leading role, strengthen the relationship between the government departments, establish the government, the public participation mechanism, fully mobilize the self-protection consciousness of the publishers and other rights holders; secondly, improve the relevant laws and regulations system, improve the market access system, and use the price law to strengthen the price adjustment of the book industry. Thirdly, strengthen the law enforcement and standardize the law enforcement team; finally, pay attention to the daily management, carry out the anti Book piracy and theft printing work, develop the economy, improve the citizens' ability to buy the positive books, strengthen the public opinion propaganda, and improve the identity of the social attack on the piracy and theft of books. In order to improve the existing measures and means to combat books piracy and theft, we hope to make suggestions on making more effective measures to combat books piracy, piracy, piracy and protection of intellectual property rights.
