清代黔东南契约习惯法与国家法的冲突与调适

【摘要】：清代康熙末年,黔东南清水江流域开始出现大量与山林买卖、林木运输相关的民事契约文书。清代黔东南地区民事契约关系主要依靠民族习惯法维护,但国家法仍然对黔东南人们的契约行为进行了一定的规范和限制,在黔东南地区形成了国家法与契约习惯法二元并存的状态。清代黔东南契约习惯法与国家法在契约文化、契约形式、契约内容、纠纷解决机制等方面存在冲突。同时清代黔东南契约习惯法与国家法之间存在互动。
[Abstract]:In the late years of Kangxi in Qing Dynasty, a large number of civil contract documents related to the sale of mountain forests and forest transportation began to appear in the Qingshuijiang River basin of southeastern Guizhou. The civil contract relationship in Qiandongnan area in Qing Dynasty mainly depended on the national customary law, but the state law still regulated and restricted the contract behavior of people in the southeast of Guizhou. The state of dual coexistence of state law and customary law of contract was formed in the southeast of Guizhou. In Qing Dynasty, there were conflicts between customary law of contract and state law in Qiandongnan, such as contract culture, contract form, contract content, dispute settlement mechanism and so on. At the same time, there was interaction between customary law and state law of Qiandongnan contract in Qing Dynasty.
