对城市基层社会自治结构的制度性分析

【摘要】：中国城市基层自治制度施行以来取得了显著的成果,给群众提供了自我管理、自我服务、自我教育的平台。在村民自治、居民自治、业主自治的施行过程中,三种自治制度之间因其职权范围和自治主体的重合,相互之间发生交叉与融合的现象。并且随着我国政治经济的发展,“村改居”等改造计划使得原有的自治制度无法适应新形式的要求。基层社会自治结构供给现状与现实需求出现了差距。新形势下三种自治制度的问题,对村民自治、居民自治、业主自治三种自治结构的制度性进行分析,探讨三种自治制度的现实关系,并且对基层社会治理的制度性供给现状与现实需求之间的差距进行分析。进而对相关制度的重构提出建议,以期促进我国城市基层社会自治制度健康发展。
[Abstract]:Since the implementation of the system of urban grass-roots autonomy in China has made remarkable achievements, it provides the masses with self-management, self-service and self-education platform. In the process of villagers' autonomy, residents' autonomy and owner autonomy, the three kinds of autonomous systems overlap and merge with each other because of their scope of authority and the subject of self governance. And with the development of China's political and economic development, the reform plan, such as "village reform", makes the original autonomy system unable to adapt to the new form requirements. The supply status of the grass-roots social self-government structure and the actual needs have appeared. Under the new situation, the three autonomous systems, three Autonomous structures of self governance, resident autonomy and owner autonomy in the new situation The system is analyzed, the realistic relationship between the three kinds of autonomous systems is discussed, and the gap between the present situation of the institutional supply and the actual needs of the grass-roots social governance is analyzed. And the suggestions are put forward to the reconstruction of the relevant system in order to promote the healthy development of the social autonomy system at the grass-roots level in China.
